HELP!! Got TRUSTEE letter today 12 days before my 341

    Just finished responding to my US Trustee letter which is why I have asked here in the first. I think I have done okay. I have gather up 448 pages of bank statement (6 Months), tax return (2 years), mortgage paper, credit report, judgment or law sue. I will deliver it tomorrow. in person to the US Trustee who is requesting this.

    I called my trustee and he is not talking at all, his secretary said that they can not give advice. They just said give them whatever the court is asking for and go to the meeting.

      Great, I have delivered a few things to my trustee personally
      like I said before my trustee wouldnt talk ( beside a "hi and did my secretary take care of you?"), I spoke with his secretary only
      but they are already being nice to you because in reality you are suppose to turn in last 2 years tax returns info and I believe pay stubs for last 3 month ATLEAST 7 DAYS BEFORE CREDITOR MEETING. But good luck keep us posted

        I totally agree. I filed pro se in October but I read the nolo book cover to cover and did a lot of research online and visited this forum before filing. I was very nervous but I did feel like I had a genuine understanding of the process. I had to deal a few bumps along the way but for the most part the process went very smoothly and now I am 4 days away from my discharge!

        Good luck with whatever you decide to do.

          Going to deliver all the paperwork this afternoon. Talked to my trustee and his assistant will not say anything. However, I've talked to the US Trustee who requested these paperwork today. She said these are just routine. She sends 15 out of 200 filings as standard procedures. She is even happy with my effort to put everything together. She said that she prefers Pro Se because we turn in paperwork faster comparing to lawyers, because they turn in stuff that are funny to her and doesn't make sense. Basically, she is trying to help the pro se as she said, so just follow her instructions.

          I guess I am little bit on their good side to start off. Hopefully I will be good for my next week's 341

            TTSM, I think you got a good one. Hang in there! If anything is still not right at the 341, he'll tell you exactly what it is and ask for amendments, and give you a few days to complete them (usually like 10 days) which is not the end of the world at all. The way you describe it now, you're already closer to getting everything filed correctly. You are winning! The thing you want to be careful of -- and seem to have avoided by a country mile! thank God -- is an automatic dismissal based on incomplete or incorrect filing, or the trustee's motion to dismiss based on the same grounds.

            I think you're actually in pretty good shape!!! Good luck!!!

            P.S. to Newimges: You rock! People like you and Rilbrianne and AAChudneyMiles et al are the ones who gave me the courage to go pro se... I truly hope it works out for you, and you sail through discharge and closing with nary another peep from anyone. Good luck!!!!

              Thanks FreshLikeADaisy, I have read through the nolobook you recommended. Delivered all the paperwork yesterday but didn't get to see my Analyst from the UST. I also gather up all the check printout from my online banking and called her this morning. It seems that she didn't want anymore stuff from me and that what I have for her was enough already. She said that the only major issue I had was I put car payment and there are no creditor for it. But after she saw my wife's filing she was fine with it. So I repeated my question to her and she said that I am okay (but, she sounded annoyed by me probably she has too much case to look at and not just my and I was being too cautious and wanting to provide too much paper work; I guess that is a good sign).

              I now pretty much have an idea now with this thing.

              1. At filing, make sure that you filled everything that there is on the filing paper ( it will be good if you type it instead of writing it).
              2. Prepare 6 months of all of you and your wife's bank statement with check register copies; 2 years of income tax (state and federal); mortgage loan document for the past 2 years; credit report at time of filing; any law sue paper from the court (so long as you didn't commit a fraud (you would know if you have a warrant or got arrested).
              3. Complete both Credit Counseling (before file) and Financial Management Counseling (before discharge)

              I think that if you have everything ready than at 341 they just determine whether if you truly don't have asset and credit will make claim if you have asset. They want to have first dip of your asset for sale.

              Please correct me if I am wrong about these. (I need to know if I am correct prior to my 341

                TTSM, you got it absolutely right, with one little exception.

                #2 -- that is the basic amount of paperwork. BUT, in reality your trustee could actually require MORE or LESS. There is a minimum required by law (60 days worth of paystubs and last year's tax return) but beyond that it is up to your trustee and you pretty much just have to give them whatever they ask, however little or much. So it's not surprising to me that after you got your banking materials together, the trustee didn't want to take them. It's good that you have it; just hang on to it now. You may not need it but it's good that you have it just in case. It's rare, but trustees have been known to change their minds on what they want and ask for more at a later date. From what you wrote, you're good.

                Everything else you wrote is right on the money as far as I can see. Maybe someone else has something to add. Good luck to you!!! I have my 341 this week, so I'm sweating a little bit too right now...
