The information provided is not, and should not be considered legal advice. All information provided is only informational and should be verified by a law practioner whenever possible. When confronted with legal issues contact an experienced attorney in your state who specializes in the area of law most directly called into question by your particular situation.

It has just been filed a couple of weeks ago. There has not been a meeting of the creditors yet.

Yes, you can easily back out at this stage from what I understand.

i was wondering just out of curiosity, that if you have already paid your lawyer in full, and you decide to not go with bankruptcy do you get your money you`ve paid back? still no papers signed yet and no meetings have taken place yet? just curious...

If the attorney/paralegal have already prepared the petition......they probably wont refund your money. Because the work has already been completed.

When I signed my agreement with my attorney, the paper specifically said that there would be no refunds, for any reason. I don't know if it is the same for your attorney, but once they begin work on your case, there is no way they will give you your money back. Maybe they will give you back the actual filing fee, which they should have collected with their fee. My filing fee was 200 something for Florida and the attorney fee was 600. So, I paid him 800 total. Maybe if you call them before they file your petiton, you can at least get you states filing fee back. That seems like it would be the fair thing for them to do.
