    Forclosure Question

    We filed bk on 2 houses, we almost sold both of them on short sales but the buyer for the second house backed out on me recently. So, the house is now scheduled for foreclosure on July 12th. My question is: Since the house is going to be foreclosed on, can I go back in there and take out some stuff. The house is less than 1 year old and in great condition at the time we left it. What I really want to do is go in there and take some stuff out, like a couple of light fixtures and the dishwasher. Will we get in trouble if we take these items? We put so much into the house we can't take such as landscaping and painting. Now that we have a new property (a fixer upper) I don't want to spend money on some stuff if I don't have to. I feel terrible about asking this question but I have to know, after all we are getting screwed anyway because of the foreclosure, will they come after me if I take a couple of light fixtures out of the house?

    I don't know if it's legal or not.. but I would do it in a heart-beat, especially since the house is not foreclosed on yet. You are still the "owner" of these items, aren't you?

    Sheeeeet... I'd get everything I could out of there that I paid for. Nothing structural, of course..lol.. I mean you don't want to go ripping out copper pipes or anything or peeling off the tile roof.. but, specialty lighting, fans, appliances.. yep, I'd do it.

      As long as you have the "keys" it's yours...
      After surrendering, its "breaking and entering". More trouble than you would benefit from.
      I told them they'd get mine just like I got it - no wallpaper, no carpet, no appliances, etc. Just a stripped down home that I re-did. If I had too I would take out the landscaping and sell it too.
      I didn't surrender my home - they took it in a Chapter 7.
      So, "so much for being NICE" to them.
      They'll get it like I did when I paid for it, with no extras.

        What do you mean "I didn't surrender the home - they took it in a Chapter 7", I hope that means it forclosed and you had it discharged in your bankruptcy?
        Yes, I still have the keys even though we haven't lived there since April, technically I guess it's still mine until it's forclosed, right? I mean I was going to sell it on a short sale recently until my buyer backed out...
        Anyway, I'm not planning to strip the property by any chance, just take a few things. I guess these things came with the house when I got it, the nice fixtures, the diswasher... but does it matter... it's going to be a forclosure so I don't think they expect much, do they?
        I guess what I'm asking is has anyone ever left their house in a not so great state before forclosure and had no problems with it???

          Our home is being foreclosed on on July 5. I have yanked everything out I could (appliances, lights, fans and such). I am thinking about selling the AC and taking the disposal and breaker box(if I had a place to put the cabinets I would take them, too). As long as I don't burn the house down and take the $100,000 insurance check and deposit it in my account I really don't see what they can do. If I am wrong someone please tell me before July 5.
