AA, did you list it on Schedule D (Secured Debts) when you first filed? I'm just curious.
Because your current interest in the car is $0 (you're upside down on it) that's what you would put as the value on Schedule B, and you would not add it to Schedule C because there's nothing to exempt and even if there were, you're giving it up anyway.
Also make sure it's on your Form 8 (Statement of Intention); I'm sure it was but just double check that. If it wasn't there then refile Form 8.
I think your trustee thinks there is equity in the vehicle when there really isn't, and that's what this is about. What's cool about this is that since the value is $0, none of your numbers change, and so you shouldn't have to redo the Summary and Statistics (the first two pages of Form 6), just Schedule B.
Be sure to call the clerk's office and ask what format they want the amendment in: a whole new complete Schedule B, or an additional Schedule B that has only the car. They're both listed in the Nolo book, you just need to know which format your court wants them in.Last edited by FreshLikeADaisy; 12-18-2007, 10:06 AM.Nolo Press book on filing Chapter 7, there are others too. As far as I'm concerned it's his bad when he didn't figure it out from Schedule D, because these trustees DO pull your credit bureau, NADA estimates, etc when you file and he should have known you were upside down. But if this makes him happy, all you lost was a day and maybe some hair.Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Oh crap! Thats not how I listed it. I listed the KBB of the car. The Sch D is right, and my statement of intention says I'm surrendering it.
So I should find out how they want it amended then, eh? I used software to help fill out the forms and the KBB is was auto filled in the Sch. B, so I went with that. I also showed the KBB on my ex's truck and the 50% of the house I own.
Should I just wait to see if the Trustee questions it?LifeNLemons In Nevada and Broke
