    my 341 experience pro se

    ohh my first I sat through about 50 people pro ser's are last I guess. I was feeling sick like i was going to throw up and hot but cold. Trustee was dry and didnt crack a smile no small talk. finally he called us up. first let me say he was taking people houses and tax refunds. When he called us up we sword in and sat-- mind you my kids are there.. He pointed out i made one mistake didnt list my car in personal property and I would have to amend.. he also ask me many more questions then everyone else i was the only pro ser he ask me how much i had in my banking account day of filing I replied under 10.00 which is true he ask if i was sure I replied yes and he asked me how much i paid for my computer my mind went blank I answer it was over 1k but with 21% it ended up alot more. he was seemed very dry. he said you had a tax return of 5k i was like yes sir. He replied something about a homestead deed. I said I had one he repied he need that and the amendment within 10 days. My day is ruined I feel like crying - I am sitting up in my bed now just worried I dont need this for another 2 months. why would he ask about my computer and my under 10.00 in my banking account.. ohh yeah did i say he said if i need anything from you i will contact you... urggg

    AA, it still sounds routine. He didn't tell you that your listed exemptions were out of line, just that you needed to add your car to Schedule B and give him a copy of your deed. To me, that sounds very hopeful. You'll want to redo Schedule C as well and claim your motor vehicle exemption too!

      If you filed pro se and only made one mistake on the forms, you did a great job! I'd die if I had to fill out those forms by myself. A friend of ours who filed bankruptcy gave me a copy of his petition to see and I thought my head was going to spin off when I saw how thick it was.

      It sounds like you just had a sourpuss of a trustee. I read that there have been more bankruptcies in the first 9 months of 2007 than in all of 2006, so the trustees must be getting overwelmed and crabby. In one of my books on bankruptcy, it said that sometimes when you file pro se, trustees will give a bit of a hard time. I'm not sure why, maybe they feel the average person isn't knowledgeable enough to do the forms perfectly and they get mad when they see someone do a good job.

        Sounds like you made it through pretty okay, especially filing on your own, so don't knock yourself out about it. Just take the rest of the day to breathe and relax and know that you are on the downhill side of things. Just get your forms amended and filed and you should be okay.

          ohh my I feel better I do.. this trustee did also say because I made one mistake he was worried I didnt read everything in schedule B .. I have read it so many times "yeah" my head about popped off. You all are right I saw lawyers having to do amends for there clients and lawyers who didnt tell their client that this trustee mite and would likely take their home... another thing I notice how many times people have filed bk in the past it was like all the people before me filed just about 10 or a little more before.

            That, and they're probably working overtime to get through with everything they have to get through before the holidays.

            I've heard that too, about trustees being harder on pro se filers. I really really hope that's not true, but I can see why it would be. I do know the trustees don't like having to deal with pro se filers because it's more work for them all around and they don't have your attorney to buffer them from a pro se's ignorance of the law, but they also make a very lucrative living so I can't feel too much sorrow for their hard lives, know what I mean?

              yeah i understand, I was thinking the same thing. He thinks I am dumb and he will have to baby sit my case.

              How would one list a financed car that is going to be surrendered.. owe on it more than its worth .. its just confusing because on schedule b it asks
              CURRENT VALUE OF
              DEBTOR’S INTEREST
              IN PROPERTY, WITHOUT
              DEDUCTING ANY
              SECURED CLAIM
              OR EXEMPTION

              my guess the interest would be 0 right? since more is owe than its worth and would it still have to put as exempt ?

                Exactly. But in a way that works to your advantage, too. If he thinks you're dumb (and as a woman, it's not like you've never had a man do that ) and you play along, he knows he has to make extra sure you get notified of this and have this and that explained, etc. In other words, you get better service and extra attention. Works for me. Mine can think I'm dumber than a box of rocks, as long as he just tells me what he wants, shuts up when I give it to him, and gives me my discharge!

                  Right!!!! because regardless if he likes it he has to do his job and that give me my discharge.. and I am ok with the way my paperwork is filed ..
