    Creditors claiming no notice???

    I have a few questions. I tried looking around but haven't found the exact answer I think I need.

    I included comcast cable in my bk, which I filed on 10/12. I have continued to get letters from them and a quasi third party collection agency. I have told them 3 times on the phone that they were in the bk. The first time they took the info (case number, etc) and said it would be taken care of. This was on 12/3/07. I have since gotten two more letters. When I talked to them this morning they said i needed to fax them the information since I don't have an attorney. They could not verbalize what I need to fax to them. I don't mind faxing/sending out info as there are several accounts that I need to work on, but I don't know what I send, what my responsibilities are etc...

    Also, for accounts not reporting correctly on my reports, do I send letters to the credit accounts as well as dispute with the Credit bureaus? The links to the sample letters didn't seem to fit what I need.
    I want to be very aggressive in cleaning up my report. We were lucky to not have any go to collections before filing, but I am very scared of the junk debt buyers, etc...

    fax your page that has the filing date and chapter along with the credit matrix naming them as a claim. just remember that will remove it from your credit saying included bk but like any other service company lights, phone ect if you ever use them again you might have to pay the bill and pay a deposit

      Amelia, if you check your bk on PACER, there may also be a "Certificate of Service" where the court files the report from the electronic notifications and mailings. It's worth taking a look at if it's there, because if Comcast was notified electronically there is just no excuse whatsoever. That, and what Sandhall said, except I would fax/send RRR a letter stating the filing date, chapter, case #, and whatever the Certificate of Service (if there is one) said, such as, "According to the Certificate of Service filed by the court on ___ [date], Comcast was notified _____ [by mail/electronically] and cannot claim ignorance of the automatic stay in order to continue collection efforts against me. You are in direct and knowing violation of bankruptcy law and can be charged with contempt of court." Or something like that, you get the general idea. Good luck!!!

      P.S. FYI, I just checked my own case on PACER (I filed a Proof of Svc by Mail yesterday and wanted to make sure it got entered) and that certificate of service I mentioned above was listed on the docket sheet as "BNC Certificate of Mailing - Notice of Meeting of Creditors".

        Since I know you lived in Chicago for a while, have you ever known Comcrap to get their billing right??? They are the absolute worst!
