I've read most of the posts here.....my story in short....
divorced 2 years this March....according to our divorce...He is responsible for all the credit cards.........I have the mortgage.

2 of my children live with me 20 & 9.....I'm done with physical therapy and I'm looking for a job. My ex is not paying in full his child support or alimony or any credit card bills. I just was handed papers that I'm being sued by one of the CC co's.....now I've told them all over this past year that He is responsible and gave them all, his phone number and addy......and Yes he did take CC's out in my name when we were married but I have no proof...so I'm in the hole about $50 thousand....He owes me over $40 thousand in support........I really don't think he'll ever pay the CC's off in my name if he can't even pay the Support ordered by the court..sooooo
I just looked into filing chapter 7.

I really thought since I have $0 balance on my Am. Ex. that I could keep that, it's a gold card you pay off every month....but after reading what you guys said....you loose everything. I'm currently stuggling to make my mortgage payments and I'm one month behind but I don't want to BK my mortgage.......I live in MI if that counts for anything.....I have no cash for a lawyer.........I really want a fresh start and a job....could anyone just shove me in the right direction.....oh and I looked at all the forms on-line....my income is way way less then the Means so I do qualify for BK..........thanks

where in michigan do you live? I am in Jackson. You should get that mortgage current before you file. Do you have a car? I would start gathering everything. Look for absolutely every debt you thought you had (check credit reports, statements, divorce decree everything) and start making a list of what to include. Let everything go but essentials, like mortgage, heat and food. What type of job are you looking for?

Livonia, MI.....I lease a car that my dad co-signed for...need to keep that....I have a BS in Nutrition but have worked everything from Sales to waitressing while I was married part-time so I could still do the kid thing.

I'm looking for a job that pays...lol...but seriously I have no one to pick up the kids from school so I basically looking for hours that would work with that.

Are you saying that these credit card accounts were opened without your knowledge and permission? If so, the application itself is proof, as well as spending, etc.

yup thats what he did....this was going on for about the last 5 years of our marriage....I just want this over with..ya know.

This doesn't have anything to do with your bankruptcy, but he if opened those accounts without your knowledge or permission, he used them but you never did, etc. you need to go ahead and report that as fraud. First step get a police report. There are other people here who have been in the same situation and said it helped a lot. In fact, there's a thread right now that deals with the exact same scenario.
