    6 month proof of income question

    Quick question. When the trustee bases everything on the prior 6 months worth of income, is that as of the date of filing, or the date of the 341?

    I think it is as of the filing date, but was just curious as I had an inkling of doubt.

    It is 6 months as of the date you filed.
    Bankruptcy History:
    Chapter 7 filed - 10/12/2005 - Asset

        I just talked to the trustee about this, my attorney saw my bank statements, but he only asked me for two months of income. I'm an independent contractor. I mentioned that to the trustee, that he saw two months, but I have all my income written down for the six months. Wonder if that will be an issue? It's clear on my bank statements.

          Argh. Now he just said to not talk to the trustee. I just wanted to clarify stuff from that darn packet of paperwork. I don't have paystubs.

              Well....Do they think we are going to tell them something we wouldn't tell them?

              He now has me more paranoid and scared out of my mind than I was before.

              I'm pretty honest. I just wanted to clarify what was needed. I'm leaving the state as soon as I can after that 341. I don't want to do double the paperwork.

              Though...I did tell the trustee, I'm a detail person, and never having gone through this before, I want to get you what you need, and it's somewhat overwhelming.

                The guideline is to answer the trustee's questions and NEVER volunteer anything. That's why your lawyer isn't happy.

                  I wouldn't worry about it, but I would quit talking to the trustee. That's what you pay an attorney for!
