    OK, finally going to ask, does BK wipe out amount owed to BK attorney?

    I have a bankruptcy attorney that I've been working with. He's been great. I'm certainly going to pay him. I don't want to ask him this, because I don't want him worrying about me paying him, LOL.

    But, I have been curious since I started down this road...

    Does the bankruptcy wipe out the amount owed from the person filing to the bankruptcy attorney? If not, why not?

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

    If you file Ch 7, 99.9% of lawyers will require you to pay them in full before they will file your case.

    If you file Ch 13, almost all Ch 13 lawyers will be paid in full by the trustee as a priority creditor.during your Ch 13 plan.

    So the answer is no. There's no fee to wipe out because it's already been paid in Ch 7 and the plan pays the full fee in Ch 13.

      If we could do that, it would probably be pretty hard to find a bankruptcy attorney.

        Plus, the BK law allows "adminstrative expenses" of the estate, and your Attorney's fee falls into that category.
