OUr hearing for our car is 12/18, our last date for objections is 12/10.
Has anyone had this situation? My concerns before was that our hearing would interfere with the chapter 7(i.e. they would try to convert to a 13 if they won't allow the vehicle) and the hearing would occur prior to the discharge date.
Its somewhat tempting if its possible, to not reaffirm, or if the judge says no way, to try to find a cheap car prior to the hearing and just let it all go since its after our last date for objections.
I asked our atty if the hearing interferes with our discharge date and he said no, so anyone have any thoughts on this?
it would be 400 bucks back in our pockets if it doesn't go through - or we just let things play out? We had to declare hardship, and do not have a letter from friends/family(had another thread on this) to support us, even though our atty put in in there that we have family to vow to help us, and could provide proof (he told us since we don't, if they ask, just state family changed their minds now).
Is there a way to do this and scrap the reaffirm and they don't look at your disposable? We are negative on schedule J even if they don't allow the car payment.
Just wanting some opinions if anyone has any, or experiences with this.
