    When do you find out if you are an asset or no asset case?

    Does my attorney see the judge before my discharge? Thanks .

    You can find out by checking PACER after your 341 meeting. The paperwork filed by your trustee will often (but not always) say whether you are an asset or no asset case.

    Ask your lawyer if you don't have a PACER membership. If your lawyer is familiar with the trustees and their usual practices in your local court, he/she can probably tell you right now whether your case will be an asset case or not .

    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED

      I was able to check Pacer the day after I filed and the trustee had already determined I was a no asset case...

      Must be slow in my district

        My meeting was yesterday, I checked PACER today and it said no asset.

          Ameliabedilia, did you know that you were no asset going in? My attorney has told me mine is a straight forward 7, since I won't be keeping anything. Has to get an appraisal on crappy jewelry though. It was about $300.

              Same here. Though I could sell myself to medical experiments, but I have no idea what I'm worth monetarily. HAHA :P

                This is an old thread but it addresses my question - Has anyone in GA recently had a 341 meeting - and if so how long after the meeting did the notice of no asset show up on PACER? It has been 2 weeks for us - there is some questionable property the trustee could choose to leave alone or make an issue of - so we are anxious. Our attny doesn't seem too worried but that does not make me feel better - It's my life! Does anyone know if I should be worried?

                  My case on PACER also says no asset, but I think that you have to wait on the Trustee to make the definite determination after the 341. I could be wrong, but I think the attorney will file it the way he/she believes it will be, but the Trustee makes the final call. That's what I've gathered from reading here.

                    Right - it has been listed as no-asset since we filed b/c that is what we filed it as - Now I am just waiting for the trustee to declare that it is no asset - and he has not done that. I read in one thread that should be done 1 to 10 days after the mtg. It has been 2 weeks since ours. I am sure that it can vary depending on a lot of things - I am just anxious since we have issues of concern - plus my mom in law is taking us on a trip for spring break and the property in question in hers so she is anxious too. It would be nice to get good news before we go - but if we end up getting bad news I guess I'd rather get it after the trip. Anyway - just trying to get an idea of what is typical in my area. As usual my attny just says quit worrying and won't give me any more info. So we'll just keep waiting!

                      when people say no-asset case- what about their vehicles? that is my only asset at this point- do you people just drive clunkers? i'm going to have to take a 722 loan.

                        It all depends on what you can exempt, as well as what you have.

                          We had enough exemptions btwn my husband and I to cover our van which is worth 8K and in pretty good shape. We are reaffirming the loan on his car. We hve no equity in our house so we are good there. We did not have enough exemptions to cover the property that my DH is listed on though so that is what we are waiting on. Our attny seems to think that b/c DH's name was added to the deed just for inheritance purposes - and b/c it is undeveloped land that would not sell easily -and has 3 people's name on the deed - and we did not pay for it and pay no taxes etc... he thinks the trustee may leave it alone - so he filed us as no asset. We're just hopeing the trustee will do that!

                            My vehicle is not an asset b/c I owe more than it's worth. It's not a junker.

                              so if you are declared an asset case, do you still procede with the BK as usual (60 days from 341, discharged)? Or do you have to wait until all assets are confiscated and sold before they will discharge and close you? I have a tax return in question...may be able to cover it with wildcard or unpaid wages.
