The trustee asked for my last years tax returns. I don't have them because I didn't file. I didn't file because I owed money I couldn't pay. Can I file now and pay the tax I owe and give a copy to the trustee?

Poorme, you may want to can an affidavit of why you did not file tax returns and of course you have a good reason, no income, no taxes, no need to file?

If a debtor planning to file bankruptcy didn't file tax returns during the previous two years because his/her income was under the mininum to file a tax return, then that's ok. The filer explains to their lawyer and then follows the lawyer's recommendations about what to do about the missing returns.Originally posted by poorme View PostDoes the "all returns filed" apply for a person who was/is unemployed and was not required to file because they had no reported/earned income?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
