    Time frame

    I have a question. I was planning on filing the first of December, but the responses to another question I asked, made me realize that I needed to wait a while, at the earliest January. Thus I have a couple of questions:

    1 - At what point in time while the calls from the cards turn into something else? What is that something else? Will they typically attempt to serve me next or will it go to theier in-house attorney or will I get a notice in the mail about turning this matter over to an attorney? I ask this because I'm heading into the 90 days past due area, which I know isn't that bad, but I just want to be prepared for the next step.

    2 - Would it be in my best interest, based on everyone's experience and knowledge, to hold off until February so that I could file and get my pitiful refund to pay property taxes and car insurance and house insurance? Or would this appear to be fraudulent, or could they make me pay it back? Would this be a preferential treatment or payment?

    I'm 4-5 months behind. I have just about every major creditor calling non-stop. Lot's of letters threatening bad things but no legal action. Just recently I started getting unsolicited settlement letters. They're averaging 60 cents on the dollar.

    Watch the mail for letters saying you have 30 days to validate the debt. This was normally in the first letter I received from a collection agency when an account was turned over to them. You should always ask to have the debt validated if nothing else then to delay legal action.

    I think you're fine with #2 just document where the money went.

      Definitely agree with #2 ! Rather see my necessities paid off than in the hands of a greedy Trustee! SAVE YOUR RECEIPTS!

      Stall those creditors, even send them a couple bucks if you can.

        I defaulted on cc's 1 year ago big time. no letters, no lawsuits yet but tons of calls on the answering machine. I guess everyones milage is different...

          I stopped paying all of my bills June 2006 and I just filed this week. I had creditors calling me like crazy. After about 8 months, they began to taper off to the point I only have like 2-3 still trying to call...

          I had someone stop by the house looking for me once, but I was at work and my wife told them to come back after 6pm and I never saw them again, but I never had any problems with the courts or anything... I was/am around $50k in debt

            Thanks. I wasn't sure at what point stuff started to happen. I'd like not to keep putting filing off, put knowing that I can wait and wait...and in jbr12's case wait and wait and wait some more. LOL Thanks to everybody here for asking and answering questions I have learned so much!!

              We are about 75-80k in debt. Couldnt pay creditors around June-July 07 (about 27 CC's)

              Got served by Chase Sept 27th 2007. in the process of filing now.

              I would wait until legal action or you just cannot take it anymore (the phone calls ect...)

              Might be good to retain a BK attorney for now - So that you give your creditors his/her phone # and refer them to him/her... (a little less stress for you)

              some attorneys you can retain for $100.

                tech, are you saying that chase served you 60 days past due??
