    US Bank - Auto Loan

I was just curious if anybody here has any experience with US Bank. I filed a chapter 7 last week, my lawyer said he does not believe in doing reaffirmation agreements. I originally was planning on reaffirming my auto loan with US Bank, but now am reconsidering. I plan on continuing to make payments and keep the vehicle. Has anybody had problems with US Bank when not reaffirming an auto loan and keeping the vehicle.

    Thanks

Don't know about US Bank's policy - but whatever it is - if you do not reaffirm it, and plan on making timely payments make damn sure your payment is ALWAYS there several days before the due date. US Bank is known for its unreliable processing of incoming payments depending on the volume of mail received each day - unless you make online payments and you get a confirmation page back.
Even one day late - and no reaffirmation agreement - will get the car repo'd.

Not absolutely will. More accurate to use the word could

For sure I would use online banking, auto-bill-pay or cashier's checks to pay the car payment in case you ever need to prove the payment was paid on time. "The check was sent on time - look at my check register" just isn't going to cut it.

I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Luckily there is several US Bank locations here where I live so I can make all payments in person and get a receipt on spot.

I set up all of our bills to be paid electronically and automatically from our checking account so I never have a late payment. This is the only way to go especially after a bankruptcy.

That sounds like a good plan. I had an auto loan with US Bank and I was able to make my car payments online with them, no problems (however, the online statements stopped once they received notice of my BK). I never reaffirmed the loan when filing for BK and was able to keep the vehicle as long as the payments were paid on time.
Chapter 13 filer since Feb. 2018 under a 60 months payment plan
Please think positive and do not give up!
