    Broke....and need to declare 15k+ in debt

    First of all hi. I have posted here in the past..and still haven't had the money to declare bankruptcy.

    I haven't been able to pay my CCs since 2005 when my son was born...I also stopped paying a car loan because my cousin whom I got it for decided not to keep it..the car was a wreck and I just called the bank to take it (REPO)...The balance owing on that car loan is still about 6k. I am scared and nervous as to what can creditor do to me.

    I am not working, on cash aid (welfare), mother to two boys. full-time student, one of my sons has a genetic disorder and needs full-time care and a bone marrow transplant. I cannot work because he cannot go to day care. I have no assets, one car which is not working anymore after a car accident...yeah my life is really not enjoyable right now...so can anyone please help me a bit..

    I would like to know if there is any way I can declare on my own, or if there are any free attorneys in S. California that can help me with my situation. I receive calls all the time, so do my mom and sister...it's embarrassing when they tell me that some called almost harrassing them to get me to pay the money.

    Please help me in figuring out the steps I should take to solve this huge issue in my life. Thanks.

    Check to see if you have some form of Legal Aid in your community. You might be able to get free legal assistance there.

    You might also qualify to have your filing fee waived or be allowed to pay it in installments. Call the Clerk of the Court's Office and ask them about the criteria. If you do qualify, there will be forms you'll have to fill out and file.

    Research and learn. You can successfully file on your own. It's referred to as Pro Se.

    Even tho you can't afford to hire an attny, call around and see if you can schedule some free Consult appts with BK attnys. You can learn a lot about how to approach your own case from them.

    Ask anything you want here. People are always more than glad to help out.

    There's forms available on line that you can fill in and print out.

      Sounds like your judgement proof anyways .. Creditor can bot garnish government aid such as ssi or welfare. no asset nothing to take. Suing you would be a waste of time and money. so still do duing with hopes you will buy a home or vauble one day and that creditor would but a lien on it but the way you explain it they could garnish anything anyways,,

      I understand your worries I feel the same way but dont stress out about the entire thing it will be over soon.
      I agree I would call legal aid or do pro se.. there are docs you can file with the court to have the filling fee waived all together, so just dont worry yourself too much and work with legal aid.

      and as far as the calls you can try to send a cease and desist letter the creditor tell them to stop calling you and family and to contact you only if needed by mail.. thats worth a try.

          If these are collection agencies it sounds like they're violating the law and you may not be fulling exercising your rights. Check out the Collections forum for info and know your rights. Here's a link. Folks here can help you interpret this and give suggestions for enforcement, sample letters.
