I think my account as been frozen!! help!!!

I just got paid today and I am being blocked from my account. payroll said there is no deductions on my paycheck, so it must be frozen instead. I havent been able to file yet, its been hard to come up with the money for it all. I'm freaking out cos now I cant pay my rent and cant come up with the money to file.
I have been unable to get a hold of the bank to find out whats going on. is it better that it is frozen instead of garnished? if I file really quick, can it be unfrozen quick?? is there anything my lawyer can do, should I call them? o my god, im so scared!!

Sounds like your bank account might have been frozen. If a creditor took money from it, you would still have access.

Hang in there. Deal with things one at a time. First call the bank and find out what's happening at that end.

Ask your lawyer right away if he/she can help you. How much have you paid your lawyer? If you haven't paid the full retainer yet, he/she may not be willing to interact on your behalf, but you won't know until you ask.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

You get sued and lose, that's an action a creditor can take.
If you know you've been sued, stop DD and change banks. Keep the balance at a minimal level.

This is the 2nd or 3rd thread concerning this in recent weeks. Are folks ignoring the summons or are the banks doing this arbitrarily? It seems strange that these accounts are being locked up without the account holder having any knowledge.

we actually do need to change banks, but wouldn't the creditor find that you switched banks and just start freezing or garnishing from that new account?

              They have to find itfirst.
Let's back up. Have you been sued? Why do you need to change banks?

We are moving soon to a different state where our bank is not. So we have to open a new account and wait the 91 days before we can file. My husband is being job transferred there. We still fall under a federal exempt though. I just emailed my lawyer and he said that most companies do not have the time or money to do anything like that right away, but apparently it's happening to enough people on this board. No,
were not being sued, but I get about 3 messages a day from CITI about the 2 months of not paying them. I"ve already called and told them that we're filing BK, but they still call.

That depends on how busy their payment processing area is to go through all the payment envelopes and look for your payment, if you sent them a check. As you know checks have the bank's name, routing number and your account # printed on them. Send them money orders.

Would they be able to see it on your credit report?

another question I just though of. I have a CITI flex line of credit in my name only. I am not working right now and it's not in my husbands name. Can they still garnish his wages even though it's not in his name? I haven't paid them for going on 3 months now. It's for almost 10k. Thanks

ok cyndy breathe!! looks like it was a false alarm, the bank said my card may have been de-magnatized. but it has lit a fire under me and I will get this filed this month, even if I have to get a payday loan to do so. ( I have all my payday loans paid off, and will be able to pay this one too) no more delaying, this really scared me.

I know.... I hope that it doesn't happen to us, but I figure that they can track it once it goes on your credit. Right now our current back account is on our credit report.
