Okay....just got to work today and previewed my check which shows my pay for 10/31. I get 1404 per pay check(2x a month)...and the TAX LEVY has gone through and my check is for $346.00. I just received the letter last week and it stated that it will take place in 2 pay periods.....the next day after i received the letter i fax it to my lawyer...and they called back and said everything was taken care of.....Apparantly NOT...omg...how in the heck am i supposed to live off $345.00 w/ a 5 month old...even if i wasn't in BK...how can the Govt take that much out....im not understanding.....

The gov't levies paychecks to get the attention of the taxpayer. It is the last resort tactic to get the taxpayer to contact the IRS to set up a payment plan. And you know what, it works. The IRS knows you can't live on the measly amount that is left. By the way, there is a formula for determining just how much is left each payperiod and it's based on the number of dependents you claim on your W-4.
For someone who is not in bk, they would call the IRS, set up a payment plan and the IRS would release the levy.
Your attorney should get on the phone with the IRS immediately, informing them of the stay and the levy should be released immediately. Stay on your attorney until this is done and you have a copy of that release in hand to give to your employer.I used to have a life, now I have grandkids.
