    time frame question

    Ok, I have a question.

    Right now, we have a garnishment on our wages. This is leaving us with $624 a month to live on. (Husband's employers are giving them everything above $351 for the garnishment.)

    We're talking to a lawyer this week. Now, let's say we decide to file bankruptcy. We NEED that garnishment to stop so we can have the money to file and to hire an attorny.

    The automatic stay happens when we file correct?

    How long from filing does everything start to happen?

    ** looked up some stuff for you and you can Protest a garnishment because of hardship... but its a document you file which you would have a court hearing to present why the garnishment shouldnt be or be as much ..

    **** automatic stay and by filing your bankruptcy you would instantly create a federal court order called Order Of Relief this is to stop collection efforts I know that will stop them from trying to take garnishment out on you but if you already have one ..?

    what you can do is go to some free consults with a GOOD Lawyer -schedule a few on you and your husbands days off and compare notes.. you will find that finding a good lawyer is most of the hard work. once you do he will have a sure answer on what he is comfortable with doing with your case.
