    I need Help Paying off My Bankruptcy Attorney

    I went to court in September for my 341 Meeting and all went well; completely uneventful.

    The balance of my filing costs is $1000.00. Because I was forced to move from my previous residence, I wasn't able to pay the balance off as planned on 9/30/2007, so now my attorney has threatened to hold required documents from being submitted to the court until the balance is paid and if I wait too long, my case could be dismissed

    Does anyone know of a place that will assist in paying off Bankruptcy balances (long term lending). I am worried that my case wil be dismissed if I don't pay the balance off by 10/31/2007...

      Do you have family or friends who can loan you the money?

      Can you arrange for a partial payment by 10/31 with the rest by a certain mutually agreeable date?

      What are the "required documents" that your lawyer is holding back?

      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        yes yes yes file them yourself. all you need to do is go on pacer and see what you are missing or simply call the clerk's office and ask them. come back to this site and tell us and we can help you get the forms. you don't have to let your case get dismissed. This should not be hard it you've alread had your meeting!!!! You should, however do EVERYTHING within your power to get the money together for your attorney ASAP!!!

          How do I go on Pacers? What information do I need? The form that my Attorney said will be withheld was the credit counseling certificate. I have a copy of it myself, but don't have a clue about how to file it.

          I wish I had family to rely on for help, but that's in a perfect world

            have you tried working out a payment plan with him... ? but i agree do it yourself.. pacer will have the letter the clerk sent to your lawyer about missing info. if any. .for example it would say signature missing on such and such docs. please sign and return in 10 days... So if is important you act quick as your case can be dismissed if your over the deadline... how to get on the pacer ...
            pacer.psc.uscourts.gov/ register if you want access now enter credt/ debit card info dont ask for id and pin to be mailed .. takes like a week.. then follow the directions on there.. if you have more question come back here.. Good luck

              I did send a request asking for the following arrangement:

              10-19: $350.00
              11-02: $300.00
              11-16: $350.00

              But I haven't heard a response yet. She is always in court, so I e-mail and leave meesages.

              My retainer fee was $350.00 when I filed Chapter 13 back in May. I plan on taking $350.00 to the office tomorrow and seeing how things go. I was more afraid of the time it took to pay it off, but I assume paying it this way kind of gives her now way out; right...

                I believe there is a form you need to file with that certificate, but that will be VERY Easy to do and then you can pay your attornwy with the plan you mentioned. what a turd to hold you hostage with a dismissal. She should be reported on that! Your bill with her is one thing but withholding your certificate seems unethical and should be dealt with.
                Can anyone chime in with how he should file the certificate...what form is used??

                  I don't know about the Form that gets filed with the Cert. The only thing that shows on PACER for our Certs is the Certs. No Form shows.

                  Go to the Court House,......... Or call the Clerk of the Court's Office. Tell them you need to file your post BK Debtor Ed Cert. The Clerk of the Court will help you out.

                  Check your case filing to be sure that all you need done is to file the Debtor Ed Cert.

                    Got a 401k? If so, take out a loan on it and pay him. Thats what we did.
