    I got a new job offer - about to file bankruptcy

    I think my bankruptcy might have just gotten a little more complicated. I'm planning on filing for Chap 7 next week. I just finished paying my attorney today and they're getting all the paperwork ready.

    When I got home this afternoon I got a call for a company I had interview with offering me a job.

    Here's the deal. I've been looking for a new job because I currently commute and hour and a half each way to work. It only took my 13 minutes to get to the interview for the company that wants to hire me. Plus the company offered me more money then I make now (by almost 20K per year!)

    So I really want the job and I wouldn't start until the end of this month (about 2 weeks after I file).

    What affect is this going to have on my bankruptcy? With the new job I'll be over the median. By the way, I'm going to discuss it with my attorney tomorrow but I thought I would see what you all thought.

    P.S. - I really don't want to get stuck in a Chap 13, boo hoo.:

    who cares if the new job will effect anything, its a no brainer, closer to work, more time at home (other then driving 3 hours a day), savings on gas, car maintainence...seems like this would be a plus more then a negative...
    If you have already filed all the paper work and all that stuff, your atty may say dont worry about it, who knows.

      Definintely ask your attorney how this can affect your case. My thoughts were that as long as your numbers are accurate as of the date you file your case, then you're okay...Any new jobs and increases in income beyond that are yours and not a part of your BK.

      Talk to your attorney first and see what he has to say. It may be that you just simply can't start until after you've filed.

        The only way this would be a problem is if you trustee asks at the 341 if you have had any changes in income. If you haven't even recieved your first paycheck yet, the answer would be no.
        And while it is a question commonly asked, not all trustee's ask about changes in income. Mine didn't.
        Even if you have to convert, worst case senario, would you still be better off?
        Deffinatelly ask your lawyer his/her opinion.

          I talked to my attorney today and he suggested I delay the new employment as far out as possible. Of course it's easy for him to say that. The company wants me to start two weeks from Monday as long as my background check goes through in enough time to give my current employer a 2 week notice. I'm trying to figure out some way to delay the new employment but I can't think of a good reason and I don't want to blow this new job.

          I was supposed to fill out the paperwork next Wed and file on Thursday but my attorney is going to try to put a rush on it a get the paperwork by Friday. He said at worst the trustee may convert to a Chap 13. I hate the thought of a Chap 13 and if I knew ahead of time I'd have a Chap 13 I'd almost be willing to risk not filing and trying to pay back creditors on my own since I have this new employment. I'm not behind on any other bills besides credit cards.

          The bad thing is once I decided to file Chap 7 I stopped paying my credit cards and now all the interest rates are at 32% plus all the fees added. I feel like I'm stuck now.

          If the trustee tries to convert to a Chap 13 it's too late to back out completely, isn't it?
