    Question About Rent

    I have a question about paying rent. I called my attorney and he has not called me back yet so until he does....can you guys let me know if when filing for CH 7 you have to still keep paying your rent? I want to take my rent check and pay my attorney. Is this advisable? and if I do it what are the consequences?

    ALSO.... kind of the same question but about my son's school tution. He goes to a private school and is a senior. I am still paying last years tution and now this years tutuioj has been added on for a totoal of $8500. I pay $250 every two weeks. DO you think if I add the back balance in my CH 7 that he will get kicked out or can they do anything???

    Because my lease was up at the end of September and I already knew I was moving, when I filed and with my attorney's approval, I included the management company as a creditor. This gave me enough to pay his fees and have a little breathing room for once. Now, I'm sure this sounds tacky, etc. but I lived there for 2.5 years and put up with a LOT of BS. As far as I was concerned, this was payback.
    If you aren't planning to move, you may want to think twice about not paying. while the automatic stay can buy you a few days or weeks, the landlord will probably ask the court to lift the stay and allow an eviction -- and the court will probably agree to do so.

    I'm not sure about the school tuition, sorry.

      Tough call. Who is the landlord, private or company?

      I would have suggested pulling your son out of private school, but a senior?, wow, that would be traumatic for the kid.

      I would probably look for a cheaper place to live until he graduates, and do anything to keep him in school for another 6 months. Talk to the school. I would even go so far as telling the school admin and reaffirm the tuition when you file BK.

      Normally, I would say the family has to share in the BK problem, but in your case, I think it is far too much to ask of a kid.

        If you plan on continuing to live there, I would continue paying the rent. But definitely see what your attorney advises.

        Most private schools are pretty strict regarding payment. You should check the contract you signed and see what it says about missing payments, etc. If it is a small school, you may want to talk to someone in the office about your situation. Maybe they could "forgive" or reduce the past due balance. I know how hard it is to squeeze out tuition, my daughter goes to private school.
