Filed Today!!!!

Well my attorney filed Chap 7 today. Our 341 meeting is scheduled for November 13. He called the bank that has the loan on my car we are surrendering and informed them of the BK filing today and faxed over the paperwork, we are 2 months behind on it. An hour later, the bank called me to try to get the two payments I'm behind on. It was so nice to say, "we filed and my attorney already contacted you so you are not suppose to be calling." Yeah. Pretty sad I get excited over something like that, hehe. Now I can officially get the car out of my garage according to my attorney. It's been sitting there for two weeks.

So we are started and are officially part of the BK Club. While the situation has been stressfull, I'm already beginning to feel some relief.

We're not filing until around the 3rd week of October but I might have the 341 meeting before ye, because the 341's around here are only running 3 weeks or so after filing.

I know how you feel. Some creditors have been calling with a really nasty attitude and when I pick up they start in on me, as if scolding me, saying "Mr. Kettle, you are now 72 days delinquent... blah blah blah..." I let them finish their little spiel and then I go, "uhhh, let me give you my attorney's number"... I love it, especially when they are jerks or when the bank was one that raised our interest rate to 32.24% from 7.99% the day after I missed one dang payment!

However, some of the creditors have been very nice and when I tell them we're filing they say, "Well good luck in the future!" I thought that was as nice touch on their part.

I mean, really, the phone caller shouldn'dt care - it isn't their money! But I guess some must get bonuses for getting us to make payments, or something...

Since we filed late yesterday afternoon, I've only had the pleasure of speaking to one creditor, fortunately they were nice. Should be getting more calls today. It's a great feeling though to say "We've filed, call my attorney." I feel like I actually have the power now, hehe.

Just got another call, guy starts out real rude and threatening me, told him I filed yesterday and he shut up so fast, HAHA. Loved it.

Call techs have certain statistics they need to make to qualify for bonuses ect. usually. For example they had X number of promises to pay, X number of payments, X number something else. I would imagine since bankruptcy resolves your debt to a certain extent that that works into the techs stastics somehow. I'm guessing it depends on the company how that works.

hello and welcome.....good for you....I had a lawsuit pending and when the atty called the lawer and gave him the case # phone went dead......ha ha....good for those rude collection

Trust me I will. Attorney is confident that our case will have no problems. We've been completely up front about everything, not hiding a thing. Actually gave the attorney more info then he needed, he got a kick out of that. He said people usually don't give all the info we gave. Told him we just want to make sure everything is covered.

Feeling so much better already, can't wait til November 13!!!!

BTW, the beater car we bought definitely has some character. You hit a bump in the road, and the electronic locks go up and down and the light in the car goes on and off, hehe. But it runs, what more could you want, lol.

Last night after the first call, I told my hubby "The phone lines are now open, please call."

I know it sounds silly, but it is fun. I had a creditor call me this morning, then an hour later someone else from the same place called back. It was great letting him have it, telling him he wasn't suppose to call since I gave the information out already. He apologized for bothering me, and swore no one else would call from his office. I loved it!!!
