    Central Air unit

    Good evening folks.
    I have a question. It a new central air unit considered a luxury? I had to purchase a new one a few months ago and I didn't have the cash so I had to use credit. It cost $6400. It wasn't the best unit but I got what was just enough. I live in a hot state so in my opinion, central air is not a luxury. What do you think? Thank you all for your great help.

    a few months being how long? I would not think it is a luxary but a necessity I would be willing to argue that one to a judge if need be. My opinion
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

          I DO think it was a necessity. If I my A/C had gone out and I didn't have money I would have charged it. You didn't say whether or not you had already decided to file bankrupcy but that wasn't the question. The question was whether it would be considered a luxury and my opinion is that it is not a luxury. I agree with you. There was a thread from Southerbelle that was very similar this one from friday. For some reason I can't find it.

            I am in the process of financing my new unit. I don't really care at this point if it is considered a luxury item or not, but when it hit 100 degrees in my house, I started calling repairmen. Worst case scenario, I'll have to pay it back, but I live in Louisiana and it is not a luxury item if you ask me, and besides, I thought I might try to get financing while my credit is still good.               An A/C unit is necessary especially if you live in a hot state. I live in Phoenix, even though we are coming towards Oct it is still aroung 106 degress to the very high 90s everyday. To be honest, it is almost always hot or warm all year long. Our winters are cold at night but during mid day we are back to 75 and sometimes 80 degrees. So if you live in an area like mine, run and get an A/c unit. It is better to get it now while your credit still allows it, you don't know what tomorrow will bring.
              Success is reachable, stretch out your arm and grab it.

                Keep in mind, even if the AC is not considered a luxury expense, that doesn't mean the creditor cannot object. Regardless of what you used the money for, all the creditor has to do is prove you took out the money with the intent to not pay it back.

                If you are going to finance an A/C unit, my suggestion would be this....
                As with any purchase, wait the requisite 90 days from the date you make the purchase before filing BK. Make at least the minimum payments on that account up to the time you file BK. Doing so will not guarantee that no objection will be filed, but you start putting the odds in your favor.

                  Just curious, don't they put a mechanics lien on the house when the a/c work is done and does that make it a secured debt?

                      Depends on the State...but also, they can only do that if the workman don't get paid. Even if you finance through the installer place, the workman and materials get paid by the finance company. So really, a mechanics lien is unlikely.
