Of course, the wiser decision is too wait until after your BK is over before acquiring such a debt. Now, A/C is probably necessary and I don't think there would be much of an issue because it can be a justified expense, but keep in mind that any debt incurred so close to filing could be objected to and you may have to repay that debt.Bankruptcy History:

There are Free-standing A/C units that you can buy for about $199-$399. (you still need to have an exhaust outlet I believe, but these cheaper units would be a more economical way to go than spending 1000's on a new whole house A/C unit, and you can move them from room-room, vs having to mount one in the window.

You guys.... She is in 100 degree weather with humity. Maybe because I live in Phoenix, I understand how hot it can get. If you get it now you should be okay for December but it necessary, you can die from extreme heat. A big fan is like a hot hair dryer. Unless you guys live in extreme heat you will not understand. However, maybe you can continue to make the payments during and after chpt 7. Homes in hot climate areas it is a must to have central air.Success is reachable, stretch out your arm and grab it.

Hey worst thing that can happen is they can object and she could have to pay it back outside the BK, right! I would GO FOR IT and stop suffering! Or you could actually reafirm the debt in the bk....... I am from Louisiana originally and know how hot it can be!!

Let's be serious. Her place is >90 degrees and the a/c is dead?
BUY ANOTHER ONE. Find a decent one, and it won't cost you more than $300, if that. Put it on the card, keep the receipts and be ready to explain it. This is NOT a luxury item. But buy it now, so it is as close to 90 days as possible when you file.
Remember, the law says that any large purchases made within 90 days of filing, the presumption is that you are bankrupt during this time. So, the burden of proof is on you, not the creditor. But, you have a rock solid explanation as to why you bought it. Besides, it is less than $500, so I'd be very surprised if anyone objects. We are talking Louisiana and Central A/C....like AT LEAST $5000-7000, right?? I wouldn't normally condone spending once someone has decided to file, but like I said before she can always choose to reafirm the debt. But she will be filing outside of the 90 days and this is not a luxury purchase. It will be up to her how she handles it when this day comes to decide, but I would say that when it come down to to it it would probably be dischargable. But we are not here to make that decision either way. Girl, you go out there and you get that A/C and you do what you got to do to keep you family healthy and comfortable and then you handle the legal/financial stuff down the road!!!!!! Your ex had left you in such a mess. You shouldn't be suffering because of this. I talked to a couple of repair guys yesterday and one gave me a quote of $6,000 after only looking at it for 15 mins. Yeah Right!!! He didn't even want to deal with my older unit (keep in mind this is a 20 something fella that didn't look to get his hands dirty). The second guy has more integrity and explained everything and told me I only need to replace the coil on the outside unit. He is in the process of finding one that will fit. Hopefully it won't cost too much, but as FreshStart06 said, here the tempts are in the 100's with humidity in the 90's. It feels like it's over 100 in my house even with the windows open and with the 2 new cyclone type fans I just bought.
I think if this second guy comes back with a reasonable quote, I'm going with him since he offers financing and I don't have a huge chunck of cash. I purchase my brand new 2007 F150 in March and then filed BK in June and it was not even an issue.
