    University Parking Tickets

    Does anyone know if University parking tickets can be discharged. My Ch. 7 was discharged back in March but the local Community College won't let me register now because of back parking fines which I included in my Ch. 7. They are telling me that this is a state fine (it's a state college) and that it's not dischargeable. Is this true?

    Is it small $$?.. If it is, just pay, move on, & forget it...

      Whether its true or not isn't the issue. The issue is how much hassle, time, and money you have to try to get this resolved. Are you really prepared to go back into bankruptcy court, re-open your case, and file an adversary proceeding to find out if the school is right.

      Best advice, pay the tickets and move-on (and buy a parking sticker next semester).

        Thanks for the advice. LOL! Okay I will pay it. It's only $35! However I know some folks who racked up over a $1000 in tickets and if that was my case I would certainly try for the discharge.

          I'd just pay the 35 dollars because probably would cost more than that to fight it through the courts.

            not dischargeable. I included mine, but they would not discharge. They are in the same category as speeding tickets...good try...lol. (that's what they told me)

              the actual fine is not dischargeable but the late penalties could be..

              The actual fine isn't dischargeable but there is case law where the 'punitive' penalties are. The fine that adds 25/month can be considered a 'punitive' penalty, those types of penalties and fines are dischargeable but usually only if the initial fine is over 3 years old. Some courts have held these fines to same standard has tax penalties. Where even if the tax isn't dischargeable (a late return wasn't filed on time) but if it is over 3 years old, the associated penaltiy is dischargeable.

              So if you have a 5 year old parking ticket that has ballooned into a $1000 fine you may get away with only paying the original fine.
