Trustee With A Bad Attitude...Feedback Please!!

    good point FO7, however, I think it depends on where you live. Honestly, here in Arizona it looks like almost everyone is going pro se even chpt 13. The day of my meeting only three people used lawyers (including that guy with holes in his shoes) and I am talking about for the entire day (because the list of meeting was out for anyone to view) only three people. I even looked at pacer and every case I looked at they were pro se.

    My trustee looked annoyed everytime the lawyer tried to talk but that could mean other things.

    I will admit, some cases really need assistance of a lawyer. I read some cases on pacer and I don't know how they closed without one, some cases were at first summons to be dismissed for huge amounts of asset found but some how the filer got discharge.

    6ftlady, I am just so happy you got no assets. We are all on this boat together, the last thing I want to see is something go wrong.

      Oh yes definatly some cases d need attorneys. But most could go with out one I think. I live in a lawyer friendly area and got attitude from clerks trustee and other attorneys. I am just glad it is over for me it was the most stressful timeframe of my life looking back I dont think I should have been so stressed but I couldnt help it . LOL
      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

          I read in one of my bankruptcy books that some trustees give pro se filers a hard time.

          It's good that the 341 is over and went well! I wouldn't worry about the negativity at all as long as the result was good! Congrats! I wish I were done!

            I can see how the judge would be a bit angered as well, and you could of found a reliable car for much less then $600/mo. for the kids. There are minivans ( brand new ) for less then that. ProSe is generally for people who really have absolutely no money, no car, nothing.
            There is no way I'd let my g/f go without one. We'd find a way to scrape up the money. It's way too risky. With a 7 no asset, maybe not as bad, but with a 13, no way.
            Glad you made it through though, you set a good example for people who choose to file on their own, but I know I'd be sick with stress the whole time.
            I'm not in a financially bad way like my g/f is right now, but I used to be a few years ago. I scrimaged and went online to find anything I could to get me through a tough week.
            I think some BK attorneys charge too much and $1500 is hard to come up with.
            The attorney my g/f has charges only $800 total including fees for a 7. I saw her paperwork and he broke down all the fees there, and he took payment plans. It was $100/mo or something and I'm sure there are attorneys out there that have those.

              and one of the reasons for the new BK reform bill was the presumption that people were out there charging up their cards etc and then declaring BK but still got to keep their expensive cars and houses. With autistic children, you might need a bigger car to keep them safe while driving. I know it is all water over the dam now but I would have told the trustee that you have handicapped children and needed the bigger vehicle for them and left it at that. No comeback needed there. But congrats on your discharge.

                As long as the car was leased, it qualified for a Chapter 7, no matter what kind it was......

                Had it not been leased, he would have told you to get a cheaper auto........... and dismissed your case for possible abuse.... Basically you are renting the auto, you don't own it....

                Trusteee was being a "smart a**"............

                  Its a stressful time.

                  Glad that you checked PACER and see what's going on.

                  Go ahead and get that 2nd class done and submit your certificate from it . Don't let that time creep up on you.

                  He probably was doing a power trick and it can be nerve wracking.

                      I am very happy to know that someone understand the emotions I felt and the tension that was building up in me at the moment the trustee made that inappropriate comment. I knew I was not crazy. While he was talking, I read his face and he had this hateful expression that you could never miss once your are used to reading faces. Since this is what I do all day, I knew immediately when the tone of the meeting changed. It all started with the 2005 Cadillac. I looked at him in nothing but a professional way until he made that comment. I had to restrain myself from jumping across the table and choking the life out of him. When he started shaking his head and rolling his eyes, I kept saying to myself "is this for real or what"...because up until that point, he had been completely professional with everyone who entered the area. Get this...one guy next to me who was filing had an Infiniti 2004(that he was keeping) because his lawyer told him he was. Of all the nerve. But, thanks for keeping me calm.

                              I filed pro-se and my trustee actually appreciated it. He made my case the last one of the day (so it was just him and I in the room) and even asked me how my day was going (which he did not ask to anyone else!). My 341 was done so fast that I caught up to a person walking to his car that had the case before mine!

                              Sorry your trustee wasn't as pleasant though. At least the hard part is over! My trustee actually grilled other debtors fairly hard (the ones with counsel).

                                I want you to know that I did go through stress...a whole lotta stress. Yes I know that 600.00 a month for a leased vehicle is a lot, but somebody took advantage of me back then and it was too late to do anything about it once I decided I needed to file. As for having money, you have no idea how hard all of this was on my just barely scraping by, not being able to go back to bad habits of depending on credit cards when I had no money, having to get relatives to pay this or that when I was in the middle of the process and doing all of this and trying to keep that car so that I could get those kids to school and back and get myself to my job that was so far away from my house it was not funny, well all I can say is this....its one thing to be in your situation, but until you have walked in somebody elses shoes, you really have no idea what they are going through. I have read so many times right here on this forum about folks who got taken advantage of by slick car dealers who charged them a lot to get a car. Yes, I fell for some shady character, but I am trying to get back on track so hopefully in a couple of years when I do decide to buy another car, things will look better and I will not have to settle for such a high car note due to being upside down, owing too much and all of that.
