    new job

    What if during a Chapter 7 case, someone gets a new job that gives them a lot of disposable income each month and they don't report it? Would the trustee or the court find out? If so, how?

    I'm trying to get a new job because my wife is out of work, and some of the positions I've applied/interview with have higher salaries that might put me into Chapter 13.

    On the paperwork and at the 341, you're asked if there are any expected increases in income within the next 6 months.
    I'd like to make more money, but I'm not expecting it.

    Okay touchy subject. But you do what you have to do. If you get the job after the 341 meeting then you can honestly say you did not expect any changes, you don't know it you are going to get the job or not. If you get the job before the 341 it is best to tell the truth but again that decision is up to you. There is a right thing to do but to be honest when you have to make decisions like that it is up to you. No one on this board even if we agree and would not tell the trustee about the new job, would ever tell you to lie. Not to say some of us would mention the job but we will only tell you to do the right thing.

    If you get a job before the meeting and decide not to reveal the info to the trustee, my best advice to you is to keep that info to yourself and never ever tell anyone especially on a public board. Me, personally I am too scary. I talk too much, I could never conseal info.

    However, believe me I am sure at least 50% of the people on this board or people that filed BK is hiding something.

    You have to decided what is best for your situation.
    Success is reachable, stretch out your arm and grab it.

      In Ch 7 your bankruptcy estate is set on the day you file. The question on the filing paperwork has more to do with known court settlements, inheritances, etc that you know could come in the six months after filing.

      The law deals with what *is*, not what *might be*.

      If your trustee asks the increase in income question during your 341 and you haven't accepted the new job or gotten your first paycheck, then you are being truthful when you say no. Many things can happen between "I accept the new job" and getting your first paycheck which is the actual time your income increases.

        This question is along the same lines - I'll have a slight raise with the start of the new school year. I'm redoing my Schedule J, would I also redo Schedule I with the new income? I'll have 1 check before the 341 with the new pay.

          Exactly. Until you get offered the job, accept the job, start the job, and get your first paycheck any increase in income is only a possibility and there is no need to mention it.

            This should not be listed on your schedules as the raise occurs after your filing date. If you have recieved your new raise before the 341 and the trustee asks about any changes to income you may have to tell them then. However, don't volanteer the info.
