    The Credit Union at my job is Stressing Me Out...help!!!!!!

    You guys have no idea how much I love reading all the post here. All the valuable information that I have gathered started right here and continues to grow. I have followed all the rules and each and everything you guys have instructed me to do and have posted about what to do has worked out in my favor all the way up to the Pacer website for information on my own case.

    The one thing I have not been able to resolve is the credit union at my place of employment. Some of you may remember that I posted a few weeks back about having a 3000.00 credit card balance with my own job credit union along with a personal loan of 1500.00. I will make this short and sweet, they have had enough time to get all the information about my filing bankruptcy. I sent the information directly to them along with any addresses of the credit card that they gave me and any other inquiry address associated with this loan and credit card.

    I am not sure what to do after Friday, because when I checked my balance with the credit union, not only did they still deduct the loan payment, but the credit card payment as well. This is a 200.00 payment for both that I could really use right now, yet they keep making deductions and I have direct deposit with the job which is required for all employees so its not like I can stop deductions if I want to automatically like we do with other places. This has me baffled and angry and I feel like really telling them off, but instead I came to the website like I always do when something small happens and ask you guys. Any suggestions?

    I can't remember did you file with a lawyer?

    It is clear they are in violation of the automatic stay. Each violation can result in a fine of 1000 dollars for them.

    I suppose you've been fearful to press the issue through a lawyer because of the fact that you are employed by them. Still if you filed with a lawyer I would contact them and let them know.

    If you didn't file a lawyer then I suppose you need to send a certified letter return receipt requested stating that they are in violation of the automatic stay because they continue to take money from your account. Keep copy of the letter and the return receipt.

    You might could see if a lawyer could help draft it up for you too if they continue to violate it.

    I know there is some fear because they do employ you, but you can't live in fear all your life and bankruptcy is suppose to help you get back on the right footing. If they aren't willing to help you out then perhaps something better will come along
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I would call and (remind them of the filing and request the money be refunded) and I understand it is your job , but they have to kep the two things seperate and if you looses your job because of it they can be in alot of trouble. It may be that the right person wasnt notified?
      Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

          Most places of employment that require direct deposit don't care WHERE it is being deposited to, but just the fact that it is a DD.

          I have never heard of an employer requiring you use their credit union to get your paycheck....check the policy on that.

            What state do you live in Lady Cop.

            Most states have laws within their labor code that prohibts an employee from being forced to have direct deposit, you probably have the right to ask for a paper check, but it depends on your state law.


            Pretty sure they cannot "force" you to bank at their CU either.


            I would stop DD and open another account at another bank, and have your pay either DD there or have them issue a paper check.

                I'm all for reading older posts to get an idea of possible situations, but isn't there some way to lock a post after a certain amount of time after it's been idle for a few months?
