    Trustees Right to share info

    My Wife and I filed ch. 7 recently and if all goes well it
    will be discharged 8-31. We sold our small company a year
    ago to an employee who is 1/2 of the way into the payment
    agreement. At the creditor meeting the trustee indicated
    he wanted the money we received from this sale from file
    date (6-6) to date and possibly the balance to be paid to
    the trustees office. Our attorney is to have approached
    him (since then)to question this as she was surprised by
    his response at the meeting.
    The individual paying us received a letter today
    indicating the trustees intention AND a complete copy of
    our filing. The copy includes a complete list of all
    creditors, etc.
    Can the trustee share this information or has he made an
    unfortunate error.

    Unfortunately, Bk is very public information and in fact you can to www.pacer.uscourts.gov and click instant registration. You can sign up for an account and look up anyone's complete BK paperwork that you would like including your own. The only thing that is private in a BK is your Social Security number. You will only the see the last four digits. That is why you are required to bring you card to your 341 to show proof. Sorry you are going through your troubles. Welcome to the forum.

      Cindy hit the nail on the head, your ENTIRE bk filing is public record (except your SSN).

      As for the business issue, I am surprised the attorney would be "surprised", unless your state has some odd exemptions, the remaining payments to you from the person who bought the business are non-exempt and the trustee is certainly entitled to them (since the sale took place before you filed BK), honestly, that situation is a no-brainer.

        Thanks a lot
        I feared the information might be public.
        As far as the disposition of the funds aquired through the sale: i am not surprised its a "no brainer". We are not pleased with the advice received from our attorney and the communication flow is substandard.
