    Question about Employer

    Hello again,

    If you file Ch 7 - are your wages able to get garnished? I thought they couldn't be; but I am reading this board and am getting seeing all different answers-I am in MA.

    CB...you posted this exact same question yesterday in the General Bankruptcy section. I answered your question there yesterday and you replied back, if anyone had anything else to add they would have answered it there as well.

    But...to answer your question again. No your wages cannot be garnished for creditors in a chapter 7.....unless you are paying child support or something of that nature.

      If that still doesn't answer the qestion mabey you could rephrase it. So that we can give you the information you are looking for.

      Many of our members are in various stages of their bankruptcy journey. Some have not filed yet and are therefore dealing with garnishments and judgements. Perhaps that has led to some of the confusion. Once you file the automatic stay goes into effect and creditors can take no action against you. Some creditors do violate the automatic stay and that is an issue for your lawyer and the courts to deal with. The creditor may face some sort of sanctions as a result of the violation.
