Divorced and Confused!

hi and welcome.....I don't know how when the accounts were in your name? was he an authorized user???? good luck with this and the journey ahead.....guzzie

He was an authorized user on my cc's, but I had him removed long before I filed bk. I hope I'm just being paranoid and the Creditors don't go after him for the debt, because I was also told by the attorney that my ex can sue me if the creditors go after him.

well if you removed him from the cc and you paid monthly pmts and charged new debt AFTER your divorce the account may have been opened before your divorce but new debt was incurred after and you made a few pmts after right? If so the debt was all done after your divorce so there for they can try but would loose that battle.

Take a copy of your divorce decree with you and show the bk attorney. See if he thinks that would prevent them going after your ex.

That or call up the divorce attorney and ask him.

Surely one of them has handled such before.

I gave my Bk attorney a copy of the Divorce Decree and he said the Creditors could still possible go after my Ex, but we just have to wait and see. I guess I just have to wait and pray that they don't.

not to sound harsh, but does it really matter at this point? You would file and then you would be done. it would be a seperate deal that they would go after him? it wouldn't have anything to do with you?

Well...that's the problem, that if they go after my ex, then he could turn around and sue me and force me to pay him back. Again..maybe I'm just being paranoid.

Maybe I don't know what I'm talking about here but i don't think he can sue you for a discharged debt? Maybe I should bow out of this thread because without knowing more info about the divorce decree I"m not sure I'm giving you good info. BTW Sadie is my mom's name.
