    Surrendering furniture

    I agreed to surrender my bedroom furniture back to the lender. It's worth about $400 dollars IMO. It's just knockdown put together yourself plywood stuff. Least little bit of water, spilled tea, coffee, or water, and the veneer is coming off....which it has and continues to do.

    On BK P/work filed by atty its listed the value at $700

    I voluntarily submitted this on my BK petiton as a surrender as I have have no way to pay them in full.

    I will sleep on the floor if I have to...to be rid of this debt, but I'm wondering, and curious.....if you consent to surrender furniture in a Chapter 7 ....does the creditor come for the furniture on your porch, or do you load it up on a U-Haul and haul it to them?

    In the case of used low end furniture, many times they may or may not actually come pick it up. depends on the creditor..... have they been calling you about it...are they treatening to pick it up??? or did you just list it as a surrender on your paperwork? if they are not calling it is possible you won't hear from them. You would never be required to bring it to them yourself. It would be their responsibility to pick it up if they wish to resposs it.

      If they want it, let them make arrangements to pick it up.

        I have a similar case but my furniture is purchase from a private lender that took me to collections even tho I was making payments. If he wants the furniture can make arrangements and pick it up outside less the amount I already paid. I would do anything until the discharge of your case and see what they want.
        Success is reachable, stretch out your arm and grab it.

          I haven't heard a word out of the creditor for the furniture, nor has my attorney.

          CindyLynn...bedroom furniture was listed as surrender.

          I'm two weeks away from final /last objections/ discharge and hope this is the last thing to worry about.

          ....so just wondering if I need to start breaking the furniture down for any collection efforts is all...

            my guess is you won't hear a peep from them!!!! its not very common for furniture to ever actually be repo'd. it would cost them more for the fuel to pick it up and the men to drive the truck than they can get for it. I wouldn't worry over it it. PLUS it they do come for it, it is their total 100% responsibility to also break it down! So there is really nothing to worry it about. I give maybe a 1% chance that you will even hear from them....now I could be wrong...maybe some others will chime in....my brother heard from his once, told them it was damaged in a flood and never heard back...and it was high end stuff worth more than $8000!

              Also, I just wanted to add, DON'T DO ANYTHING! You have already done what you need to do by putting them on you BK as a surrender. That is all you need to "do". If they want it they can do the rest. You are done!

                What I have is not high end at all....basically just put together yourself pressboard (Ikea stuff).

                If they decide they want it back then I will point them to the room where they can start dismantling it.

                I appreciate the kind advice!

                I will post back of any future developements.
