    never got paid :(

    Before i was negotiating with creditors because i was expecting to get paid for a project that i did for some company, but it's been more than a month with excuses and i realize now that i not getting paid, they always come up with some new excuse. Amount is more than 2K.

    A question for you guys: Does it make any difference when filing Chapter 7, letting the trustee know that i was expecting 2K in payment that never came, can they go after the company to try to get it or bankruptcy has nothing to do with it?

    Well if the Trustee asks if you have any money owed to you or due to you, and you say no and he later finds out about it than your case would be dismissed. So you don't want to lie to the Trustee if the money is something that can easily be traced!

      Let me point out one thing for other posters...this situation is the danger of relying on uncertain future events to cure your financial mess. To many people prolong the inevitable by "hoping" certain things will happen that never do.

      As for your specific question, yes, the BK trustee could nab these funds because your "right to receive" those funds has matured before your BK was filed. Any asset, or right to receive any asset that accrues before the BK is filed is fair game for the Bk unless that asset falls within in a BK exemption.

        When you fill out the papers. There is a place for monies owed you and you would need to list the company and amount owed. In some states some portion of unpaid wages is considered exempt. You'd need to check the exemptions for your state.

        But yes you would need to tell the Trustee.

        If the funds are not exempt then yes the Trustee can take the funds and use it to pay creditors.

        I agree with HHM I too hope for a better situation and prolonged the inevitable.

          I would tell him about it yes. We were thinking of suing our renters (who owed us $1500, AND stole all the appliances out of the house). When we realized that it would more than likely hold up our BK by doing so, we decided not to. What we told the attorney was that we realized you can't blood out of a turnip, those people were more broke than we are, so we decided not to pursue the matter. He said okay, I don't blame ya there.
