    keeping one credit card?

    Can I selectively keep one card by simply not listing it in BK (Ch 7) filing? I have a balance on it but have had it since 1982. I also have another that has no balance and I plant to keep that one "empty" to hang on to after filing, but would really like to keep the other one. I posted this on the general forum but no replies so I figured I would try here...

    Legally, your duty under the BK code is to list all your debts and liabilities. However, if you have a card with zero balance, its not uncommon for debtors to "forget" about those cards and not list them.

    As for the card with a balance, it depends on the size of the balance, if its small (i.e. something you could "easily" pay off in one to two months, again, its not uncommon for debtors to "forget" about that card.

    However, realize that at the 341 meeting you will be put under oath and asked "have you listed all your creditors" and the penalties for incomplete filings and perjury can be serious.
