    Objection to discharge

    Ive had my 341 meeting.
    The trustee found no asset and asked to be removed.
    Im in the last 15 days of my "objection to Discharge"
    and my question is. Why dosent every crediter file a objection to
    the discharge and try to make you pay them back. is there some kind of rule they have to go by if they want to file a objection.

    I would accept the discharge and leave it at that, move on. But every creditors different, sometimes it isn't worth their time and money to fight the process. Looks like you might be discharged in no time!

      They write off the loss as a tax deduction.

      If you don't have anything, its not worth their effort to spend money to try and get you to pay.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        They need a valid reason to object to the discharge. If they file for some sort of adverserial proceeding to object, they must prove their claim. If the lose, they are responsible for the debtors legal fees.
        Essentially, they must prove some sort of fraud or substantial abuse-a high threshold.
