    So Insane

    So in months I haven't gotten a call from bill collectors that were included on our bankruptcy. But yesterday I did, and she had the gall to tell me to keep it nice and to not offend HER. When I told them we had filed bankruptcy she said, "what you just don't want to pay your bills", I was like.... OHH I can't offend you but you can offend me and that she had no idea why we filed bankruptcy. Needless to say I was not nice when giving her the case number and my attorneys name and number and said that if they ever call me back that I would sue them. HEHEHEHE........ that felt GOOD!

    But other than that there is no sign of a discharge on pacer yet. Asked that attorney and they said it might be a few days to a few months. Lord I hope it's not too long. We are no asset I figured it would come pretty quick. Ohwell I guess I will just wait it out and see what happens.

    You are only 4 business days past your last day of objections, your discharge notice will be coming very soon. FYI, my lawyer also told me, it could take a few months to receive the discharge notice. I believe they do that incase the courts are backed up, as sometimes that is the case. We received out official notice in the mail from the courts exactly one week after the last objection day. The good news is you have passed the hurdle and are just waiting on the official notice.


    I agree that the collectors are insane, I remember one non-friendly that spoke very rudely to me even calling me "stupid for filing bankruptcy" and then had the nerve to tell me not to raise my voice to her and I should learn to have a conversation on an adult level. That still amazes me to this day.

      Isn't it a violation of the stay for a creditor to contact you while in BK proceedings?

        Yes it is, but that's not saying it never happens, especially with third party collectors. Just out of the blue you may get a call. Like the OP stated they informed the collector they had filed and then gave the collector their case number. There are chances a creditor/collector/junk debt buyer will still contact you and even do so well after your bankruptcy has been discharged and closed. A simple and firm "That debt is/was discharged in bankruptcy case # ????? please do not contact me again and doing so will give me reason to seek action against you." Usually that's all it takes.

                  Now its time for a name-change for you....... "just stupid" doesn't fit anymore........ now its "I'm debt free", or "Now Smart"......

                  LOL

                    Congrats on the discharge



                    Anytime the former creditors call you should notify them as you did. . Make a note of time and date in a notepad. If they call again then sue them .
                    May 31st, 2007: Petition Filed by my lawyer
                    July 2nd, 2007: 341 Meeting Held
                    September 4th, 2007: Discharged and Closed.
