    Question with Dell

    I am filing Chapter 7 and one of my creditors is Dell that I used to buy a computer in January. My attorney stated that she has never had any objections from Dell so I should not worry. One question I wondered about though was when I bought my computer it included 3 year warranty...might be a stupid question but will my warranty still be good??

    it should have nothing to do with the warranty
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

      Frankly it may depend on what the warranty states in the fine print. Do you have a copy of it? Some warrantees have provisions that negate the warranty if you stop payment on the item.

      Having dealt with a Dell warranty in the past for problems with my Dell laptop long before we filed Ch 13, I have a feeling that Dell won't be anxious to make good on a warranty when you wiped out the payment for the computer in bankruptcy. Hope you don't have to find out!

        I have DELL as part of my bankruptcy. My computer is a bit older though as I got it in 2004. Thus far they have not made any objections towards dismissal. My warranty of course was expired by the time I filed, indeed the monitor and the mouse stopped working several months before I filed.

        I don't think you have to worry about them coming after you. The warranty is probably invalidated as you expect it to be. Pull it out and read it, that's the only way you'll know for sure.

          be forewarned....Dell may try to bully you into returning the item by telling you its serured. Ignore them and they will go away. But I certainly wouldn't ever plan on trying to cash in on the warranty. They'd probably keep the computer..but who knows.

            So, you're taking their computer for free and you want them to pay for its upkeep?

              Once the computer is purchased it is yours and the warranty is still good. Look at it this way. This is exactly how it works with dell and CIT bank (Dell Preffered account lender).

              If you went to best buy and bought a computer with the full warranty and paid it with a cap one master card. Then a few months later you filed BK on cap one. Cap one cant call best buy to have your warranty null and void. One they cannot do that and two its a waste of time. So no dell will still honor your purchase because dell got their money already. So you should be alright.

                  DELL typically finances through DELL Financial. If you purchased the computer as you suggest then yes the warranty wouldn't be in trouble. But if he used normal DELL financing then yes the warranty is invalid after bankruptcy.
