    Where to include certain incomes

    There are some monies received that I'm not sure where to record.
    I think they should go somewhere on the Statement of Financial Affairs.
    But I could be wrong.

    Here are the particulars:

    1. Refund check from college, it was in March (90+ days ago)

    2. My father is loaning my husband $1500. But since my husband hasn't received his greencard or SSN yet, he is ineligible to open a checking account or be added to mine, he is also unathorized to work. So, my father is sending the check in my name to be deposited into my account. Then I will withdraw and give to my husband. We will use the money to buy a cheap car - $2000 or less, since my car will be surrendered soon. This is not my debt, but my husbands... but I am the middle man becuase of my husband's circumstances.

    3. I've received reimbursements from my flexible spending account from my work for medical expenses. The funds were taken out of my paycheck, but then given back to me pre-tax.


    One expense that I have, but unsure where to include it:
    4. Unemployment compensation repayment. I was overpaid my unemployment benefits in 2005, and now I'm paying $50 a month back to them.

    I'm sending in my schedules, statement of affairs, etc
    to the court today, and need some help figuring things out.

      1. Refund check is not technically income. If it was more than 90+ days ago as far as I'm aware there is no need to list it.

      2. I'm not up on the law on this. To me I think the Trustee might look at this suspiciously. You really probably should ask a lawyer.

      3. I'm not sure how that would work never seen it. Is it listed as income on your check. It really isn't income if its a reimbursement but this could be something that might have a Trustee looking closer, like number 2.

      4. Use the Other Category as best I can tell.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        $1500 Loan/gift

        Maybe I could just list it as a monetary gift from my father?
        I spoke to my dad last night and explained the situation with my bankruptcy and husband not having bank account... he says he would give me the $1500 as a wedding gift, since we didn't have a wedding.

        Also, I'm well below my exemptions. I only have about $2000 worth of exempt personal property/cash.
        But my exemptions should list everything in my possession on 6/26, correct?

        How would I record that if he gives it to me this week?
        Since I didn't receive it before 6/26 (my file date), where would I record it.

        I will be surrendering my financed car and in desperate need of a vehicle. Without receiving money from my father, my husband and I are screwed!

          No need to record it anywhere since it was recieved after the filing date. The bankruptcy estate is set on the day you file and anything after that date is not included (with a few exeptions, of course, this NOT being one of them).

          See above answer.

          This is already included in your calculations as your schedules start with your gross income. We also use both our medical expense spending account and our dependent daycare spending account. You already listed this money in your gross income, don't make the mistake of listing it twice.

          As someone else mentined - that will go under other.

            If you got the gift after you filed then you don't have to list it, its not part of the bankruptcy estate. A financial snapshot of your accounts would have been made for June 26th the date of filing. So long as you get the rest filed in time .
