    Income question

    I am filing for chapter 7 next week primarily because my income from January 1st through June 30th put me below the median so the timing is right.

    Will they later look at income for July and August at the 341 meeting ? I ask this because I am in sales and anticipate a very decent commission in both July and August that on an average basis will put me over the median.

    Filing Ch 7 creates a bankruptcy estate on the day you file, so most bk lawyers say that income changes up or down after filing don't matter (this is not the case in Ch 13). Some Ch 7 trustees do ask during the 341 meeting if your income has changed since your filng - depends on which trustee you draw and what standard questions are asked in your district. Your lawyer can tell you what to expect during your 341.
