    Does this mean we're going to be discharged????

    This was the entry on yesterday's PACER report:

    Full docket text:
    Meeting of Creditors Held. Trustee's Report of No Distribution: Trustee of this estate reports and certifies that the trustee has performed the duties required of a trustee under 11 U.S.C. 704 and has concluded that there are no assets to administer for the benefit of creditors of this estate. I have received no funds or property of the estate, and paid no monies on account of the estate. Wherefore, the trustee prays that this report be approved and the trustee be discharged from office. Filed by Trustee (Trustee's Name) (RE: related document(s)[2] Meeting of Creditors (Chapter 7)). (Trustee's Name)

    Does this mean we're out of the woods?

    For those who don't remember, we were above the median income for our state, but were ok on Schedules I & J. Filed CH7, no asset.

    Our atty was a little concerned about having to convert to a CH13, because of our income.

    I guess my question is, is the docket text above just the Trustee asking to be "relieved of his duty" because we are no asset? Or does it mean he recommends our case to be discharged/closed?

    Also, could we still be facing conversion to CH13 because of the income?

    I sure hoping for you but it does sound like it. Were you negative on the schedules??? did you pass the means test??? We are a little over the median as well but we are negative on the schedules even going by the allowed standards and we passed the means test. After taxes and other payroll expenses we really don't make a lot of money, however my husband's income is over the median before taxes.

    What some people don't understand is the less money you make the less taxes so if you are under or at the median you don't have as much taxes taken out if you were a little over, so in some ways it levels out and you can qualify. I have met so many people that were well over the median and had no problem with chapter 7. If your numbers are correct and your schedules so no abuse then there will be no problems with Chapter 7.

      Ahh that is a good report to find on pacer. It means you are now awaiting discharge. So sit back and wait for the 60 days to fly bye.

        Absolutely good news. The trustee is basically telling the court, he's/she's performed their duties and since it is a no asset case there is nothing left for them to do, so they want to be removed from the case. It generally means, you are just waiting for the final word on discharge.

          It looks like good news and the Chapter 7 is proceeding as planned

          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.
