    Questions about my BK than im all set for discharge

    I have these 2 bills that popped up very shortly after i filed Chapter 7 in April of this year. One is for Travelers Insurance for $480 for auto insurance that I used for one moth and got charged crazy fees. The other is for my Sprint cellphone which is $750. I know I have the option of adding them to my unsecured creditors list for a $26 fee, but since my 341 is already done is it too late for this?

    I don't want my discharged to be delayed if I do this and im just wondering is there another way to get around this. If I call Sprint and Travelers up and tell them I filed and give them a case number is there a chance they could just delete it from their system? Or might they go to my Bankruptcy court and delay my discharge by objecting?

      First question, did you obtain the debt before your after you filed? Not when you were billed, when the debt occured. If it was before the date you filed, then it can be included, if it was after then it can not be included.

      If the debt happened before you filed, you can call these companies and let them know you filed and on what date, case # etc. I had a bill come in I wasn't expecting but the debt occured before filing date and this is what I had done and they just said thank you and left it at that. I never bothered to add it to the matrix. You can if you feel more comfortable that way, but some folks say in a no-asset chapter 7 any debts that occured before filing that are dischargable end up being "considered" discharged even if they were not on the matrix, unless you reaffirmed them of course. So that is up to you. It really shouldn't have any effect on you discharge date at all.

      On the other hand, if these debts occured AFTER you filed, then you are kinda stuck with them. You can't add them in.

        This is correct. But as BKTango points out, if it would make you feel more comfortable, it is worth the piece of mind to pay the $26 fee and amend your petition.
