    Yes, I screwed myself.. any suggestions??

    I filed a while back due to my company closing without notice, leaving us w/o insurance, baby boy born the month after, car accident where I was rear ended and injured my back, and then a month later my 2 yr old daughter was diagnosed with type 1 diabetes and hospitalized with Ketoacidodis..

    So, while we are happy that we have a new baby boy, and my daughter is able to get the care she needs to live a healty life thanks to medicaid paying for her supplies for now, we are in the worst financial situation we have ever been through.. We decided to let our house go since it was upside down, and way too expensive, we lived there for 9 months while I looked a new job.

    Now, I have filed for a bk pro se, since I couldnt afford the fees, and I filed at the worst time. I filed for the bk to avoid having the house sold in an auction while we looked for a new place to live, and I used my tax refund to move. I filed my taxes before filing for the bk, but recieved to refund 2 days after I filed, so the trustee wants the money which I spent to move us. I also filed for the bk fees to be waived, which was denied since it turned into an asset case because of the tax refund, and told I would be put on a payment plan. I never recieved the payment plan schedule like I was told I would be and when I called to inquire they told me the case was dismissed due to nonpayment. I have since written a letter to the judge and have a hearing scheduled next month for a motion to consider dismissal. The only thing I reaffirmed in the bk was my 2 vehicles which are upside down slightly, but run perfectly with warrenties. Since they dismissed the case they voided the reaffirmation agreements I had with them and one of my cars was recently repossed.

    My questions is, what should I do? I need a car, and with my wife going constantly to the doctors for my kids, she needs a reliable car especially in the case of an emergency. They reduced the balance of her car by over $8K, lowered the interest rate by 6%, and the payments by over $200/month, so we are hoping they wont get her car before the bk hearing. I want my car back to avoid going to a "buy here, break down over there" dealership and end up in another bad situation, and was hoping to work something out with my car company to keep the car as they gave me a great deal in the reaffirmation as well. SO, now that I just gained a new job, with a steady income (salary) and know that I can afford it, what would be the best way to convince the car company to give me back the car or hold it from the auction before the hearing, as I am pretty sure they will reinstate the case...Also, the trustee is making me pay $3000+ back that I dont have because I let a friend do my taxes and I think I did not get the earned income credit due to the amount that I had in losses. I think that if I go to a professional accountant that they may reduce my losses to give me more of a earned income credit, which would give me the same amount back, but it would be protected from the trustee. Is this an option or is it too late.. I would not be worried if I didnt think that paying it would prolong my financial recovery..


    Also, beware of filing pro se...it has cost me more in the long run, not only financially, but the heartache of the process, and circumstances put me in a negative funk.. and you can never move forward unless you believe that things will get better. Ive lost everything material, but am greatful that my daughter was able to get a free insulin pump due to our situation and is doing much better with her blood sugars.. you have no idea how hard it is to get a 3 yr old to count carbs!!

    IN time things will get better. I have type 1 diabetes. I have had it for 30 years and I am 35years old. I have four natural kids, married, and always stressed and no complication from the diabetes. I am also on the pump, got it 4 years ago and I love it. Just watch the middle of the night lows and your daughter will live a long healthy life. I did everything, diabetes never stop me from doing what I ever wanted to do. ask me any questions in regards to type 1 diabetes anytime.
    Success is reachable, stretch out your arm and grab it.

      We've said it here on the forum over and over. Yes, it's very tough when you don't have enough in pocket to pay a bankruptcy lawyer but it's so easy to make avoidable mistakes like Aveda's that end up costing far more than a lawyer ever would have.

      Aveda, it's not too late to find a good bk lawyer to help you sort out this mess. Schedule 3-4 appointments for free consultations with bk lawyers in your area. Unfortunately since you filed pro se and are now fighting an uphill battle, the lawyers are likely to charge more now.

      So glad your daughter is doing well! You can find a way out of this even if the journey isn't one you expected to have. Hang in there!

        thanks, we just got her the new Animas pump and still testing with bolus and basal amounts.. but she is doing good. thanks again...

          I know the struggles of having a child with diabetes and the expense. Our insurance only covers 50% for prescriptions, so that insulin and testing strips cost me over $400 a month. Good news is that my son that was diagnosed at 7 is now 20 and is on a full ride scholarship to college and his diabetes is under control. He also wears a pump. Diabetes never slowed him down, but I have quite a few gray hairs from it!! Good luck.

            Just to help us get a handle on the time frame,........... When did you initially file your BK??

            Chances are not good that you'll get your other car back. Most likely it's already been, or soon will be, auctioned by the Lender. Major cities all across the US have Dealer's Auctions. If you financed thru a major bank or one of the Manufacturers Credit Companies (GMAC, Ford Motor Credit, etc), their repos and lease returns are auctioned weekly.

            Just an FYI for you in case you don't understand about your Income Tax Refund,................. Since you were anticipating the Refund at the time you filed, the Refund became an Asset of your BK Estate.

            If you had received the Refund and spent it to move prior to filing, you would have been fine.

            If you had had some sort of Exemption applied to the Income Tax Refund,........... Enough to cover the $$$'s you received,........ The Tax Refund would not have been in issue.

              be careful about amending your taxes. its almost a surefire way to get audited! If you are ok with an audit then go ahead. Sorry to hear about your daughter. I'm a pediatric nurse. With caring parents like you to teach her about her healthcare, she'll be just fine!! You think its hard to get a 3 year old to count carbs? try a cat! My cat was diagnosed with type II insulin dependant diabetes 2 months ago.

                I filed in Jan., I did my taxes days before, but had recieved the refund 2 days after filing. The car company said they are holding onto to the car for a few more days to consult with their bk dept. to see if it is in their favor to work a deal out with me.. The car is an 06, but has 36K miles, and has had frame damage when I was rearended. If they sell it, they would be at a huge loss, I only made about 6 payments. They know they cant get a deficiency balance because of the bk when its reinstated. But if they give it back to me, they can recover the full amount, and I will do a reaffirmation agreement. If I default after the bk, they had full rights to go after the deficiency at that time. But I want the car because it has a full warrenty, is affordable, and otherwise I would have to go to a "buy here, break down over there" and pay more for a beater... even though I get into an upside vehicle, I plan to keep that car well past when its paid off.

                  I pray you can get it reinstated.

                  It might be a good idea considering how bad its gotten to try and talk to a few lawyers as suggested above by lrprn.

                  I was gonna do Pro Se until I found this site, and reading over here convinced me that I better get a lawyer. Fortunately I used my tax refund to pay the lawyer before filing....so its all gone.

                  Good luck to you and yours, glad your girl is getting the help she needs.
