    The trustee called today that @@@@@ said we can not have our home fixed we can not be reimbursed until there is a court order allowing so what the #### do I do I have 5 kids 2.00 2 of my kids are disabled 1 life threatning and no place to stay safely no food nothing we were to be reimbursed today for out of pocket expenses now what please some one help
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

    Did you find out what has to be filed in order to get before the judge? Surely there are emergency procedures in place that can get you before the judge ASAP. I am assuming you DID tell the trustee's office of the special circumstances with your kids. You are going to have to VERY pro-active here.

    I realize you guys are broke. But it may be time to find an attorney, at least one who can advise you on what to file to get before the judge asap if the trustee's office won't help. Call your local women's shelter, they usually know of attorney's that do pro bono work. Also ask the Red Cross and United Way. In fact, call some local attorney's and ask if they ever do pro bono work. Do whatever you have to do to get before the judge.

    There's a point to what I am about to say, so stick with me till you get to the end, ok! I had a fire many years ago, and just for giggles and grins we took pictures of the place immediately. Those pics came in very handy when the IRS audited me for taking a deduction for a casualty loss. When we were audited I took the pics and the report from the fire marshall to the audit. Both substantiated my deductions. I suggest you get pics and call the fire dept about getting a copy of their report to take with you to court. I believe they will come in handy in substantiating your need for release of the insurance funds. Shoot, I'd even take a piece or two of smoke damaged items to show what you are up against as far as having to replace everything. Sit down and make a detailed itemized list of everything you can think of that was lost or damaged. I did this after the fact and I know I missed a lot, but as an example, I had a dozen pillow cases in the bathroom cabinet. Take pics of your smoke damaged items. The smoke and soot doesn't always wash out and those things are ruined. You will need to make a case for why you need access to those funds immediately. Also, if you haven't moved out yet, you will be amazed at how much stuff that is stored in the back of closets and cabinets is also damaged. The smoke travels everywhere and then the water from the fire dept does even more damage to things. I had a 5 pound bag of sugar that was rock hard from the water from the fire hoses and my fire was limited to one closet on the opposite side of the house from the kitchen. Unless some one has had a fire, they don't truly get the whole picture of what happens. You are going to have to show them.

      Contact the trustee immediately, your attorney and anyone else. Ask how to go about getting a court order quickly and explain the situation as you have here. Other than that I don't know what to do, seems odd to me that a trustee would request a court order for you to be able to purchase food and basic needs,

        she said the insurance company can not issue a check to ANYBODY until there is a motion filed and the judge signs it and if we dont claim it as exempt (by filing a motion ) then it is property of the estate

          I cried and cried told her of my circumstances she said sorry but I dont work for you I represent the creditors interest she was so cold hearted

            I know I can't be of much help but my heart goes out to you... First of all, try a health department or family independence agency for food and other things you'll need right away. They should also be able to help with your childrens' situations. By the way, what state are you in? I don't know a thing about motions to see the judge but I hope you are able to get one filed right away so that this is taken care of.

            I'm still new to this site but I know that this is the best place for you to come for comfort and understanding.
