    Poverty Question??

    Am I reading the poverty guidelines correctly? Is this saying that a family of 2 can make up to $1711.25 to be considered below poverty. If so how do they determine your monthly income would they take the whole of 6mths and divide by those months to determine monthly income?

    They look at 6 months income and in some cases 12 months if you dont have pay stubs . They do an average income so last year we made 13800.00 total and since my husband is self employed we have no pay stubs so they averaged the 13800.00 by 12 and came up with 1150.00 per month we have 7 people in our home 5 kids 2 adults so we are way below the poverty level
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

      Okay so I have tallied up all my income from January to this Friday. I would be right about at about 9600.00 for exactly 6 months that is averaged about 1600.00 and about 100-200 of the poverty line. Is that enough to warrant trying to opt out of paying the filing fee.

      Technically I probably wont be prepared to file in another month or two so that will drop I am sure by quite a bit. Because I am adding income from the first 3mths of the year that I no longer receive. I only get about 1000.00 a mth right now.

      What do you think?? Should I give it a try? According to my attorney it was very difficult to prove poverty and waive the filing fee. But after going over trying to figure out how to pay him I decided it might be in my best interest to file on my own. Obviously I cant afford 1400.00 to file when I only make 1000.00 a month. I will never be able to file at that rate.

        yes try it and if you do not get approved they will put you on a payment plan I was successful in having my filing fee waived if you are below the poverty line when you file you should be okay but if you hire an attorney you will not get the fee waived bascily if you can afford an attorney you can pay the filing fee but I think you should be fine even now because you are making less than that now if you have 60 days prior pay stubs you should be able to verify you are below the poverty line I think the 6 month thing is the means test but on the application for having the fee waived you are asked current monthly income if that makes any sense

          Well if they go by current month income for sure I have that in the bag. Did you guys file yours on your own? Are you in the process of filing?

          I am a little nervous about filing them on my own. I have the NOLO book and the forms and I wanted to make a run of them but its a bummer you cant type on them and print them. I think there is a website where you can get the templates and actually type in the information and print them out.

          I do have another question though. I have a roommate and we split the bills right down the middle however these past few months with my income spiraling out I pay what I can when I can. How will all of this influence me filing? I remember the attorney saying something about we may have to provide something saying that she gives me income which will increase my income on my paperwork or be able to show I pay half.

            You might check to see if you have some sort of Legal Aid in your area. If you're at the level to have the filing fee waived, you might qualify for free Legal Assistance as well.

              Thanks Sinking Fast I didn't think about that. I am going to call the CC place today I think they will waive my fee for that as well. This is a plus I might be able to file sooner if I can just get all my info together.

              How long did it take you?

              I feel like the trail of bills are endless and I know you have to get it all together or it will just mess you up entirely. So I am trying to be accurate. I don't want to have something linger and come back to haunt me.

                We Consulted with attnys over the course of a couple of months. Each visit, the attny would give us a list of things they wanted to have on file. Every list had the same basic things and then a few different items.

                It took me probably a good 2 weeks to get 90% of the stuff gathered together. That's gathering, sorting, organizing paperwork. And then the rest trickled in. Even still, when we hired our attny, there were a few more things he wanted. It took me another half day to get that stuff.

                It's definitely not something you can do all at once. I had to work on it a bit here and a bit there until I finally had it all gathered together.

                  We did file pro se on 4-10-07 and had the fee waived as far as the roomates and you spliting bills just put what you are supposed to pay each month stop paying any cc companies and we also had to hand print the filing papers but just write it very neat or at least readable and you will be fine it actually makes you look more poor I think but it should be easier than you think I tried to call legal aid inmy area but they dont help w/ bankruptcy they feel it is a voluntary decision they usually only help w/ divorce w/ abuse or criminal or things where the government are involved such as appeals for benefits
