    We FINALLY filed!

    I just checked the status on our attorney's website and they filed our case on the 4th! Our 341 meeting isn't until July 31st though!

    This is going to be a loooooooooong almost 2 months!

    I know what you mean about how some people get extended 341 dates. There were people at ours who'd filed 2-3 weeks before we did. I didn't realize until I saw a Court Docket Calendar, that Trustees only hold 341's on certain days of the month.

    Don't worry about it tho. It's summer. You're not couped up inside. We have a holiday in the middle there. Time will fly by before you even realize it.

      I do have a quick question though. So, our file date is 6/4 and our 341 date is 7/31. I'm pretty sure that the clock starts ticking on the 180 days thing on 6/4 right? Can our case be closed before 12/4? If it is does the 180 days become a moot point if it's closed on say 10/6 or something like that? Does this question even make sense to anyone besides me?

      I guess what I'm asking is there is a 180 days thing after you file that the Trustee can look at right? But can your case close before that 6 month mark and if it does, then does the 180 days not matter?????

        The 180 day clock starts ticking on filing day. That part is true. But Closing is a whole different story.

        Some people are Discharged and Closed same day. Or within days to week of each other. Others have a gap between the 2.

        Our 180 days were up the middle of March. But at our 341, the Trustee decided he wanted to see our filed '06 taxes. Which we did and submitted to him about the 3rd week of February. The Trustee abandon our paltry refunds the middle of March.

        BUT, our Court has a 30 day waiting period. 30 days from the date of last posting before the Clerk will Close your Case. And at that, the Clerk only closes cases 1x a month, at the end of the month. So mid March immediately became mid April for the waiting period. And Closing actually happend the end of April.

        It's really gonna depend on what happens with your case. What the Trustee is or isn't interested in. AND, the "traditions" of your Court.

          Thanx - so the 180 days isn't set in stone, right? The Trustee COULD be interested beyond then? Yuck. I just want my life back - I've been waiting since February already as it is.

            I don't mean to hijack, but what is this "180 days" you are referring to?

              From what I understand, even though your case may be discharged AND closed, they Trustee (courts) can "keep an eye on you" for any significant money.

              I'm interested because we buy/sell antiques for a living and this could potentially be an issue. Sometimes (like every few years it seems, and we're due) we find something worth ALOT more money than we paid for it. It'd be MY luck it'd happen around this time!

                    The day you file BK, you establish a BK Estate. In Ch 7, the Trustee administers assets of the BK Estate for 180 days from the date of filing. That's the 180 days.

                    So if rich, old, Uncle Pete dies and leaves you a sizeable inheritance during the 180 day period,........... The Trustee can potentially seize your inheritance for the benefit of your Creditors.
