    answered the phone..grrrr

    I am still filling out my questionaire little by little giving some time from my last cash advance. Anyway, i was waiting a call for a job interview today, a follow up, and not recognizing the area code i answered and it was citibank, so she started to explain that i owed and whatever, the thing that worries me now is i kind of lied saying that i was going to call them next week and set up a payment plan and also i said the reason i stopped paying is because i had no job and now i have one, shoot, talk about panicking, me and my big mouth

    Two questions please:

    - Can they do anything, if assuming the conversation was recorded, regarding me making promises to pay and not going forward with it since it was a lie?

    - Also she said that we could set up a payment plan today and was asking for my checkbook and i said that i have that information on the citibank site but would call them next week, is there any way they can take money from my bank account? i don't have anything set up automatically...i tried to access the part where you delete your bank information but now the access is restricted...

    I will finish the questionnaire this weekend and see if i can send to my lawyer on Monday...

    dunno, but i was with chase and even though i knew i was in the process of filing i made promises to them id pay them something (and i did - but not quiet the amount i told them i would). in time, i filed and i never heard from them.

    thats too bad the have already denied you access, i would check w/your bank to see if anything activity is going on. i definitely would close you bank account and get yourself set up at another bank!

      havetodecide,

      Don't worry there is nothing they can do. My suggestion is next time they call and you answer just sound stressed like you probably will be and say this is a really bad time call back later and hang up.

        You mention working on the questionnare and getting back to your lawyer. If you've already retained a lawyer, I'd check with their office and then start refering the creditors to them. I just filed yesterday (I'll post the story when I get time) and when I retained my Atty, he said to tell creditors that I my attorney is dealing with that now, give his name and number and that's it... I won't say it's 100% effective in preventing calls, it does reduce them and as soon as you say that you've been advised by your atty to only give the caller the atty name and number, their whole tone changes.

          tell them to call your attorney now.This worked for me with Discover. Nor I or my husbands work have heard a peep since. Now BOFA on the other hand....they still call, but only about six times a day as opposed to 20. They left me a nasty message yesterday. Poo poo heads....(my four year olds words..)
          My kids are very stressed from the phone calls. It upsets them.

            As the others said, see if the Lawyer's office will handle those calls. Hopefully they can help you out

            Don't worry better days are ahead, I know well the nightmare of the calls

              Thanks everyone, i am feeling better knowing that they can't just take money from my bank account, but i am starting to think about opening another bank account since all my cards, i used to pay online and they all have my bank information stored somewhere, does not make me feel comfortable.

              Actually once i file, my lawyer said to give his number to whoever calls me, i should have done that when Citibank called because she asked if that was my only phone number, i should have given lawyer's... although they would call and see that i had retained a lawyer

              I don't actually receive many calls from friends and such so my phone is off all the time, again, it was a coincidence that Citibank called at the same time the company interviewer said they would be calling...but i don't usually pick up when it's on, getting too many calls from all sorts of area codes lately.

              Thanks again for all the suggestions and I'll try not to stress out too much
