My attorney has had my paperwork for a month and I guess she was sick a few days. However I paid her like 2 months ago now and i am still not filed i am going there winterbotham in l.b. ca. they are a huge group that does bankruptcies . They keep telling me they wil let mr=e know whne they are ready for me to come sign the paper work to file. This is taking forever. Sorry had to vent.

I initially retained a big box or BK mill firm (think of your local Sams club, or Costco for the big box metaphor)...but got bad vibes. I'm not sure how to phrase this....but, they are sort of like a clearinghouse one stop shopping for BK filers. From my experience they are more than happy to sign you on, with great discounts, but after a few phone calls ... (leaving you on hold forever) they kinda disappear.
I don't have a ton of complaints with the bigbox firm I hired, just that they left me on hold for over 2 hours for a simple question. It did make me wonder once it got down to the nitty gritty how efficient they would be. I decided to fire them, and go with a more local firm. Cost me about the same actually, but new attorney is quick with email reponses to my questions, and puts me at ease.

DAMN, I would be sooo irate, soon as I had the money my case was filed w/in a few days of full payment. I originally was going to file mid-late SEPT
(2005) due to having to pay monthly installments. I had everything I needed ready to go just needed the money. But luck have it my way, I got the money and my attorned was ready to go! Do you have the necessary paperwork needed to file? That is a damn shame they have been putting you off THIS LONG!
Think it would just cost you more money and maybe the same amount if you decide to "FIRE," them! I wish you the best of luck, AND I would put in a complaint to the Better Business Bureau !

CMIYC is right. If you have paid any kind of money to your attorney it's going to be awfully hard to get it back. Fortunately when I made the decision to go with a second attorney I hadn't paid the first firm anything other than the retainer. I'm still trying to get that back from them, and doubt I will ever see it again.

Worse is years later finding mistakes that Winterbotham in Riverside made on not reaffirming debts that we kept and paid on (including some that have since been paid off) so that even though the debts were paid, they do not count on our credit report. Winterbotham's answer? Pay them MORE money to fix their mistakes.Winterbotham messed up our bankruptcy and now wants more money to fix it.
