My 341 meeting is next wednesday...Scared!

I filed chapter 7 and my 341 meeting is next wednesday. When I went to my attorney to sign all the papers I asked the lady that seemed to have done all the work exept the initial consult, what questions the trustee would ask us. She said she didn't see any problems, my case is pretty cut and dried. Our income is about $30,000.00 below the states median and our only assets are two used cars and our house which are exempt. Will the trustee interrogate us trying to see if we are hiding anything (we aren't) or just ask the basic questions.

After we filed the trustee requested a copy of our tax returns and bank statements. The attorney said the trustee has everything she needs now so we just need to bring drivers license and social security card.

Any way I am a nervous wreck. Am I just being paranoid?

    Thank you.

Ours is Monday and I am freaking out. I am not quite sure what to bring. I thought my attorney would have sent us something or called - but we've gotten nothing.

Ahhhh....... I hope this goes by quickly.

    Good luck on Wednesday!

      From http://www.usdoj.gov/ust/r02/new_haven/faqs.htm#CH11Q1 :

"Each individual debtor shall bring to the meeting of creditors conducted pursuant to 11 U.S.C. section 341 the following items:

      - A picture identification issued by a governmental unit, or other personal identifying information that establishes the debtor's identity. Passports and Drivers' Licenses are acceptable forms of identification.

      - Evidence of social security number(s), or a written statement that such documentation does not exist. A social security card is the preferred proof of social security number.

      Some trustees also may request:

      - All pay advices or pay stubs received by the debtor within the 60 days preceding the filing of the bankruptcy case.

      - For the time period that includes the date of the filing of the debtor's bankruptcy petition - Statements for each of the debtor's depository and investment accounts, including checking, savings, and money market accounts, mutual funds and brokerage accounts.

      - Documentation of monthly expenses claimed by the debtor when required by 11 U.S.C. Section 707(b)(2)(A) or (B).

      - Any other documents requested by the Trustee."

The first two are must-haves! Good luck - be sure to come back and let us know how it goes, ok? I'm sure all will go well.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

It sounds like you have a pretty run of the mill chapter 7. You more than likely will just be asked your basic questions. Usually you will have to repeat your name, verify you signed your petitions, state whether or not you've sold anything in ? time..etc. Usual stuff. Try not to worry, just make sure you bring along your d.l. and ss card as intructed. It will be over really before you know it, they generally only lasts a few minutes.

I was able to find the Docket schedule for our 341 Meeting day in advance. I actually stumbled onto it at PACER.

When I saw there were 7 cases scheduled/each half hour, I knew the Trustee would be hauling A$$ to get thru it all on time. That's less than 5 minutes/case.

And by dingies! He did it. We were scheduled in the 9 am half hour and we were back home, changing clothes by 10 minutes til 10 am.

Just answer Yes and No as much as possible. Don't give any more info than you absolutely have to. It'll go quick!

Good Luck and be sure to give us a full report!!
