    Job Question

    I filed on April and I will be going to the 341 meeting on June 1st. I had been unemployed since Aug of 2006. One week before filing I took a Temp job with the possiblities to become Perm. Any Advice on how to handle the 341 meeting, Will this cause a problem with determining discharge? My income up to the 341 meeting will be $5000.00 for the past 9 months. $4000.00 since the beginning of the year. Will this change the means test?

    If you've just made $4K in 5 months, you are well below the median.
    I hope the temp job turns into a fulltime gig. You need it!

      If the Trustee asks, and you haven't had a firm offer of Full Time before your 341, then you can, in all honesty, say you are working on a Temporary basis.

      Until you get a firm offer, in writing, that you accept, pass all the pre-employment testing (physical, drug screening, etc), and report for work the first day, you don't really have a permanent, full time position.

        Yep, I agree. Until you punch that clock for the first time as a perm. employee, it is only a "POTENTIAL" perm. position!!

          As the others suggest don't mention the possibility of a full time job, the Trustee might continue the case then . Until you have it firm that you have the full time permanent job don't bring it up, if asked tell them you are working a temporary job and provide the appropriate details
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

            Temp job v. perm

            Does it matter if you work a temp job? I've been temping with the same company since August 2004 with no intention of going permanent as I prefer the flexibility of the temp arrangement.

            12/13/07 - 341 Meeting
            02/12/08 - Discharged
            02/15/08 - Case closed

              Nope -in Ch 7 it doesn't matter to the court. Just be truthful if the trustee asks about your job status and say you are in a temporary job. No need to share why

                Thanks. I'm still up in the air between a 7 or 13 but would being a temp affect a 13?

                  Yes. You need to have some fairly consistent source of income to file Ch 13. The case won't be confirmed otherwise.
