    Question about means test.

    Ok took the lawyers advise and quit the job.. Tonight I was playing with the means test calculator and came up still in chapter 13. The reason being was that our rent is 1400.00 and the area of Kern County California shows 887. Do we get to claim the 1400 or the 887. Please help.
    Filing January 08.

    If you rent then you have to take the median of the area, but could you make that up in other expenses? (if you own your house then you can use the actual mortgage amoutn)medical, charity contributions, etc. Ask your attoeney.

      Other expenses: do you own a car ??? auto insurance ??? misc expenses many don't think about: gas for your car .. groceries (food bill) INCLUDING animal expenses THEY have to eat too ! medical costs ? vet bills ? dental cost ? clothing expenses , surely you buy more than one pair of shoes a year, socks! right down to your underwear! THINK about it all and claim it ! ! ! do you have to pay for parking ??? like if you work in the city - you know !

        Talk to your lawyer about whats allowed in your district. We rent also and our rent is higher than whats allowed for our area and we (our lawyer) used our actually numbers.

          If this is correct, that is a major slap in the face for renters everywhere. What is the idea behind this? So you don't rent a 12k per month penthouse, file bk then move back out?

          I guess they don't want to ruin the housing market any further by applying the same reasoning to mortgages, but to not allow actual rent costs seems terribly unfair.

          Perhaps it should be changed-as if it eve would be-to be included under the "totality" clause or the abuse time limits. For instance, if you have ALWAYS rented there, or longer than say a year, you should be able to claim whatever rent.
          Anyone know the allowed rent in zip code 90210? I considered moving there, and i doubt the IRS standard is even in the same hemisphere.

            Deadmancrawling the rent allowed is 1431 for that zip code... let me know if you find a place....LOL

              CHEAPEST rental in Beverly Hills. Now, if 3-4 of our families team up, we MIGHT pull it off. Nice place-Two bedrooms would be kinda tight for 19 people, but I think we would manage. Neighbors would just LOVE us, I am sure

                  NYC would cost about the same in a nicer area!
                  I took some classes in LA back in the day and found it was way overpriced for everything down to a simple burger. I also found everything was way to spread out. Sitting in traffic (during rush hour) for and hour to go ten miles isnt fun really.... if you want to go out on the town and have a few there is no good public transpo, so as a city it dissapointed me. Im sure the reasons I didnt like it others love it though. There is perfect weather to boot and great scenery!

                  I have a question similar. When filling out form I & J do most districts allow whats allowable in an area or what you actually spend? For example, what if what I spend was actually LESS than whats allowed? Can I use that higher amount?
                  (Wondering WHY I didnt ask last consult this...duh!)
